I don't think Ruth can be - the "Call the Shot" Topps game will also be appearing in Series 2 and Update (plus the 2015 Topps series 1 release has some elements used by license from babe ruth's estate or marketing firm.

I can believe Ruth might be exclusive relic/cuts to Panini (if there is an exclusive) but it looks like Topps and Panini will both get to use Ruth images and name in their products.
