My rule of thumb is to always bid by the description. He could have just used a stock pic.

I believe eBay actually stores certain images now. I haven't used it, but I have heard of people using it. I hear there's an option to exclude your pics from being used as stock images, but it's possible that eBay could have grabbed that image as a "stock" for refractor.
I dunno' - you'd have to ask someone who's actually used a stock photo.
Either way - bid on the description. Or you could have just e-mailed him to ask and make sure. You obviously knew there was a discrepancy so why not ask? Or were you HOPING it'd slip in under the radar knowing you could just hit the guy with a chargeback?

Just looked at their other scans. Seems like they do use their own so it should be a gold.

Why the edit? Afraid of people contacting seller? I think it was already done. Chances are it's a gold so it shouldn't be any worry. THey sold is as a BIN so they should be happy with the price.
Edit: or maybe you were worried about the seller seeing the part about using a chargeback to protect your lack of checking before bidding?
