Is this 2010 Topps Kevin Youkilis an error?

Not familiar enough with the 2010 Topps line, but is this a variant or just a production flaw? It doesn't have the foil lettering.

In the past I've had many cards missing the foil. However, knowing how Topps has been recently it could very well be an intentional "error".

Never been, so I don't know? At Turner there were always young ladies to talk to, at least in my single days.

yes that is Yuk throwing the ball so it is an error for sure on the throw.
