I have an issue, and I need my FCB fellows to guide me to the best situation... I will not name this buyer but he's a Canadian.

Here's what happened: I sold a Yasmani Grandal AFLAC auto card on June 6th, and he bought it on the same day.

On July 16th, he contacted me, "Auto is smudged, what do you want to do? Not satisfied with thi card scan shows no smudging. Lmk"

I replied on July 18th (after a weekend away at the Beach): "Did you look at the picture of the card closely before you bought this card? It's the same card. And it was shipped more than a month ago."

He replied back on the same day "So your saying? Too bad? I don't understand how this is gonna make a good resoultion to this problem."

I answered back on the 19th: "No I never said or imply that - all I am saying is that everyone should look at the scan before they bid. Please ship it back to me, and I will issue a refund. Usually I don't accept returns after a month of the shipment. "

Finally the last response from him is this: "Can you refund the payment and then i'll ship it back, something seems fishy with you about this transaction, I also would like to be reimbursed for $2 shipping or else if you don't want to refund it at least pay the $10 for the tracked shiping costs so I can send it tracked.
Thanks!"

I have a 100% feedback (almost 7,100), and I never issue a refund to a foreigner after he demanded one. I wasn't being fishy - I was being cautious. Any help would be appreciated.

I would tell him you won't issue a refund until after you receive the card back and they ship it back at their expense.

Issue a refund after he returns this. Or give him 2 bucks off of the winning price, since that is what it would cost him to send it back.
But never issue a refund before you get the card back.

What are the limitations for refunds? After 30 days seems like a really long time. I would take the damn hit myself. And then explain it out if necessary.

I thought so, but why would I give him another $2 for shipping back, even though he paid for the card along with s/h cost?

Wait until you get the card back.

I'm currently in a reverse situation. Bought a Heyward Sterling black back in late June. Said it was mint. Almost a month later he sends (w/o DC) and the card is creased on the back. Says he doesn't accept returns. Contacted eBay and now he's accepting it as a return. BUT Paypal said I'll get my refund AFTER the card is received back by the owner.

I'd forward the communication to eBay immediately and get all of this on record. The guy's a scam artist 100%...nothing is fishy about a 7100/100% seller. Let the buyer know you have contacted eBay and, per eBay policy, he'll receive his refund upon receipt of the item.

As for time limits...they don't exist.

I don't know if I could accept a refund after 30 days because remember Canada Post Office went to strike for a week or so???

That doesn't matter...eBay will not side in your favor even after 90 days. Besides, if paid by credit card, he's assured to win.

How do we know if the buyer used a credit card? I agree with you about the stupid Ebay rule, and I don't want to get a negative on my impeccable feedback record... ;)

You won't know. If the buyer is in Canada, that almost assuredly explains the delinquency in his refund request. I have pieces that have been out for almost 4 weeks myself. That said, this could all be a case of misunderstanding; maybe an honest buyer turned off by your inquiries due to the lapsed time of the request.

However, I'd certainly not issue a refund until it's delivered. Assure the buyer that eBay has been contacted and that you are an experienced seller with clean record and he will be taken care of.

Then again, if the auto is smudged and it was visible in the listing, this was probably a calculated effort by the buyer to receive a free card.

You could drag your feet for a couple weeks, the Paypal "statute of limitations" will expire, then he can't get a refund at all..... just kidding.... mostly.

Definitely don't give a refund until you get the card back.

Thank you for the helpful comments. I will politely tell him that I will issue a refund as soon as I have the card on my hand.

And don't budge on his request for $2 more for shipping. If he doesn't like it, even after seeing the picture online, he has to pay for it himself. If he wanted to return something at Walmart, he couldn't walk in and say, "I need to you pay for my mileage because this product wasn't what I thought it would be."

I generally tell people it is all or nothing in regards to returns anyway. If you don't like it, return it. I'm not going to give you a partial refund when I could probably sell it again and make the same money on it.

Tell him send it back FIRST if he wants a full refund, or keep it and get nothing.

Yup...he went into this transaction planning to get a cut at the end.

Never partially refund the slime of eBay.
