Dude is a pack searcher, as he has sold numerous "hot packs" in the past. That's the type of person I'm dealing with.

You deserve the difference between the cards refunded.. Redeeming the card doesn't change the fact that he sent the wrong item. It just changes the way you can reach satisfaction. Good luck with everything.

Seller: A partial refund wont work for me. like i said i will give a full refund for either a unredeemed or the actual redeemed version. that is more than fair.
Me: The issue with that is by the time Topps sends me the actual card. (you surely know how timely and frustrating the redemption process can be) it likely will be past the allotted time for a PayPal refund (limit of 45 days?). I really want to resolve this without contacting paypal, I am uncomfortable with your asking me to purchase the same redemption card from someone else, then send it to you for a refund. Although we both made equally careless errors, it is worth noting that we wouldn't be in this situation if you had sent the correct card in the first place. Again,a partial refund or $20 is the fairest solution based on the past sales of this card.

I am not a lawyer but what I remember about contract law in college is that you must have an offer (his Ebay add) and a acceptance of that offer (your agreement to buy the card). The contract was not executed as he sent the wrong card but you also broke the contract because you redeemed the card basically voiding out any value his card would have had. Again, my basic understanding of contract law is that you both must be made whole as you were before the contract was executed and that is not possible as you also screwed up and redeemed the card. To push this all back onto the seller as you did in the above post is just stupid as you BOTH are at fault. Neither side can be made whole because of YOUR screw up. His offer to have you send the redeemed card to him when you receive it or have you purchase an unredeemed card and send that to him was very fair and the appropriate thing to do. He may have started this mess with sending the wrong card but you made both sides unable to be made whole with your screw up. Man up and do what needs to be done to settle this issue or just let it go.
