13% tax on sports memorabilia in Minnesota due to new tax bill

I just saw this in the paper this morning and that they are looking to charge sales tax on Internet transactions as well. What do you think about that? Do any other states have anything remotely like this in place already or that has been proposed?

I heard about the whole tax thing on internet sales but that's about it.

Illinois is close to passing this too. eBay sent out an email encouraging everyone to contact their lawmakers and voice their concerns. It sucks when your lawmakers are so crappy with money that they have to screw you by taxing you more.

I think I've had to pay a 6.25% tax from Minnesota seller's before. Might as well make it 100% !

13% is pretty excessive. Looks like they're aiming high and willing to settle for a lower number. Either way a new tax is only necessary when tax collected on everything else isn't enough.

Imagine how much tax could be collected on items that are continuously flipped! Ebay and PayPal already understand how this works.

How about a flat tax in this country. Say 40 percent of what I might earn in my lifetime Payed up front. Then they will have enough. This is just crazy tax policy.

I think all the states and federal government are looking at taxing transactions that are done online..

They need to generate revenue. And all they are really doing is applying existing taxes to internet transactions. Not like its terribly new...(although it will probably call for redefining purchase categories).

I would think if you are buying to flip or resell, you would not have to pay tax if you have a resale certificate, like now, I have to pay tax in Florida except if I am buying for resale, then I am exempt, you just need a certificate to give to the seller, the end buyer would have to pay tax.
They would have to come out with a certificate for internet sales first..

Didn't this tax all start since they didn't generate as much on the electronic pull tabs as they thought to cover the states share of the Vikings stadium?

Honestly it's stupid. Why can't they just mandate you pay regular sales tax of anything.

Well the federal bill says that businesses that sell more than $1 million per year are subject to collecting the tax. If you aren't a business with a tax ID you don't have to collect taxes. I can't imagine that you are going to have to pay sales tax on ebay too often. Directly from business owners online, probably.

One question that I have though, Minnesota (currently) has no sales tax on clothes. If I buy a game used jersey, am I taxed on it? I would assume it's classified as clothes.

I think once the "game used" tag is applied it officially falls under memorabilia. I admire your creativity though.

or they'll put a specific exemption to "clothes" in the law stating that sports-related clothing is not considered "clothes" for purposes of being non-taxable.

I do admit some gross receipts/sales tax laws are crazy stuff - I remember in the mid 80's the family took a trip out of state and I bought a pack of topps cards at a convenience store. There was no tax on food in that state and my card pack purchase was not taxed because the clerk told me cards are considered "food" because of the stick of gum in the pack! I was totally expecting to be taxed because I bought the product for the cards, not the stick of gum.

This is why Wisconsin loves Scott Walker. The State is debt free. My parents (who live in Minnesota) said the alcohol tax hike is so high that everyone is talking about coming to Wisconsin to buy their beer. One of the State Politicians called Wisconsin's Beer bath water. I'm pretty sure Wisconsin has some of the best beer in the country. All this will do is drive consumers to buy in Wisconsin and the Dakota's now.
