Acceptable shipping time to leave a negative on ebay

I won an auction on April 26th and paid immediately, after about a week and a half passed I received a message saying the post office messed up delivery and he received the package back. I said no problem just re send it and let me know the tracking number. Of course I didn't hear anything back so I had to write again and ask for the tracking number or i said I'd open a dispute through paypal on this coming Friday. No response from the seller yet but I saw there was an entry in the tracking number. When i enter the number it says this

"The U.S. Postal Service was electronically notified by the shipper on May 11, 2010 to expect your package for mailing. This does not indicate receipt by the USPS or the actual mailing date. Delivery status information will be provided if / when available. Information, if available, is updated periodically throughout the day. Please check again later. "

So basically my package still hasn't been mailed and it's been about 2 and a half weeks. The seller also has a history of doing this to other people. I think I'm going to leave a negative feedback when/if i get the card. I believe it's been a bad transaction, What are your guy's opinion? Am I being to harsh and as long as I get the card I should be happy or does this guy deserve a neg for saying it's been shipped when it hasn't, making excuses for super slow delivery and having bad comunication, plus he has a history of slow shipping but people still left positive and said shipping took a month.

Long as you get it and everything is good in that area you always have the option of taking stars away and still leaving a positive. Buyers can still gauge slow shipping by the stars and if they drop low enough he will be penalized.

Over two weeks def. is a long time, so your justified no matter what you choose. Did want to also mention though the USPS tracking sucks, whenever I send something it doesn't update online until the package has been received....so while it doesn't make up for how long you've already waited.....there is a good chance it's on it;s way to you even though it says that online.

U can also give a neutral and give seller a poor seller rating. Negative comments usually anger both parities and may get U on someone ban list so U can never bid on their item again. Is still up to U but I lead toward neutral if U do get the card.

Thanks for the responses right now I'm undecided on neutral or neg. It wasn't the same person as the other link. If you want to know who you can pm me and I'll send who it is that way. No need to make it public incase it's someone on the board which I doubt but you never know.

Not that I matter, but I never leave negs unless I don't get the item. If I get what I paid for, I usually am happy. If I am dissatisfied I use the star ratings or on rare occasions leave a neutral...
