Bowman 2010 case EBAY Problem what sould I do.

Well It looks like I got screwed over. I pre-ordered my bowman 10 jumbo case from ebay.
and I still haven't received anything.
I had a Email from the sellers "son" on the 15th telling me that his father was in the Hospital
and that he will get out on Monday (17th). I email him all last week trying to get a update, and
of course nothing.
Come last Saturday I get this email from him...

 Hi. I will be shipping out your case on Monday. I am very sorry for the delay, it was unavoidable on my end. I do apologize though for it taking so long. I was not out of the hospital when I thought I would be and it has put me very behind. I will provide the tracking # for you when it is shipped out on Monday. I understand if you are to give me a negative feedback, I accept full responsibility for not getting this out to you on time. Thank you for your patience.

Now it's Wednesday and no tracking. I called ebay and they can't even get my money back.
they only gave me he's number and told me to call the police.
so What do you guys think I should do.

That guy frequently pre-sells large quantities of cases at or below cost on ebay. That alone made me avoid buying from him.

When did you pay? Did you pay with a CC through PayPal?

hopefully you used a credit card to fund the paypal transaction. if so, file a chargeback through them.

I thought eBay guaranteed you your money back if a seller ******* out. I know i've heard plenty to dispute that fact, but their TOS seem to state that they'll pursue every avenue to recoop their funds from sellers.

You can do a chargeback regardless of whether you used a CC or bank account as long as it was through paypal.

If your paypal gets withdrawn from your bank account, you may or may not have restitution. You're allowed to dispute any Bank Transactions upto 9 months? after the initial withdraw.

Since it went to paypal, you could tell eBay that you'll be filing a claim against them and see if that gets their ass in gear.

Normally this is for larger sums of cash-money and it's a pretty big pain in the ass, but it might be worth bringing up when you're on th ephone with eBay.

Click on the item in your PayPal account. At the bottom of the page you will see a link to the resolution center. Just click on that. I think you're allowed to file a dispute for up to 90 days.

You can do a chargeback regardless of whether you used a CC or bank account as long as it was through paypal.

I think he meant credit card protection chargeback. If he just meant paypal chargeback, of course.

I know it sounds like a sales pitch, but I firmly believe in buying from established online retailers.

I've had no problems yet buying wax on ebay, knock on wood. I just could never understand people buying "Pre-Sale" on ebay. Way too easy to screw someone over with that type of sale. Regardless of the savings, I too would forego ebay and buy pre-sales only from established, reputable onling retailers.

this is my second time getting burned on wax on ebay... never again

I stayed on top of them, contacted him twice the monday he "got out of the hospital", and he had it shipped overnight for me (i kicked in a few bucks to do it). I received it last tuesday.

Not sure what to make of my situation, he seemed to be straight up with me.....But yours is not sounding great at this point.

I only contacted him via email, but I would guess his phone number would be the best bet. GOod luck, keep us updated.
