I realize most of you are not attorneys, but I'm curious if anyone has some experience and/or insight here.

The current licensing issue with Upper Deck got me thinking. Are there restrictions on posting card images on the web? For those who have their card collections posted online, did anyone check with the card manufacturers to see if they're ok with it? How does Beckett get away with it?

I can't imagine that MLB, MLBPA, etc. would get too upset, but who knows these days.

The stipulations arent that cards cant be displayed, its that new product cannot be produced after the date of the agreement. I think that UD can still sell old product made before the agreement, but not sure about that.

Everyones collections are safe.

If what you are saying is true...and it is not, then you couldn't park our car in the drive for the neighbors to see or wear a pair of designer jeans out in public.

You purchased a product and the right to fair use or display of the items.

I'm asking if I'm allowed to display my personal collection online, or if that violates copyright or some similar law. The licensing situation with UD is what got me thinking about this issue.

Would be pretty hard for someone to prove damages in this case. Wouldn't it?

Yeah...in fact...it would be the opposite as people see nice things and then want to go buy one for themselves.

Is the world that afraid of attorneys?

I don't know an attorney that I dislike
Attorneys rock

I know plenty... Was at a hearing today for almost 3 hours for three attorneys who represented the PLaintiff at different points in time trying to split up the attorney fee fairly... It turned out that #1 got nothing, #2 got less than we offered him, and the current attorney got what she asked for.... The plaintiff wound up with more. If the greedy bastards took what I offered, I would have three hours of my life back.

For me, I'm concerned because this project will require literally hundreds of hours of work.

I'm very annoyed with the greed surrounding this UD licensing nonsense. IMO collectors will ultimately suffer, and it got me thinking about what's acceptable fair use and what isn't. I'd have an aneurysm if I found out a year from now that I'm breaking the law and could not share my collection the way I want to.
