This all sums up to the reason why graded cards exist. A 3rd party to at least judge the card before you buy. I'm not sure who is in the right and wrong here. Both side have good points.
True on all counts.
In regards to the seller agreeing if there was a scratch or not, statements such as "I didn't see a scratch that warranted concern." lead me to believe that he was aware of something.
In any event, I'd say just refund and move on. One of the things I don't understand is that I see posts like this all the time on this board so I don't understand why sellers from this board still don't give detailed item descriptions knowing full well that this could happen. Though it's been over 10 years, I've sold approximately 500 items, about 125 in the past couple of months, and have never run into this matter. All my customers have been satisfied and I provide front/back scans of each card and give a description.
