So here is the situation. I buy this card on a buy it now and pay immediately.http://cgi.ebay.com/ws/eBayISAPI.dll?Vi ... 0384587690

A couple days go by and the seller says he needs to refund my money. I ask why, because the one that was live and ended the next day went for 76? He responds by saying no, it was my sons first pack pulled auto and it is his favorite player. My wife listed it and wasn't supposed to. I then say I will see it for sale again, he assures me that this card will never be relisted. Ok, so i let it go..until I see this today.

Am I wrong for being a bit pissy about this, or is the seller way out of line?

he found out after selling you the card that it was actually a short print and knew he had hosed himself by not describing it that way. Hence the excuse and then the relisting.........he plain out lied to you to make a few more $$$$

I asked him this just now
Hello
I thought this card was sold already, how come it is relisted? Did the buy not pay, or did you want more out of it and cancel the transaction on him only to relist for higher.

Yeah, I can leave negative if I decide to. During our first few emails I said I would leave appropriate feedback. He took this as a threat then told me he would get his and his brothers accounts and jack my auctions. Also said he would leave a negative after I did. I told him sellers can't leave negatives and that I should forward his threats to ebay. Any idea if ebay would like to see the email exchanges(they were through ebay) and the current auction link? Would they do anything about it since it is a contract?

"I see you relisted this card again and after doing some research, it became clear that the first time it was listed was an error and was not meant to be sold. Can you provide some insight on this?"

We'll see if they respond.

I had a feeling right away that is what he was going to do. Just didn't expect it to be so soon after he lied. It was a pretty elaborate story also. I saved the messages from him. Even though it really isn't a huge deal, it gets me pretty fired up.

Hey if you said any of this thru ebay, get with them and tell them he is threatening you and get his ass suspended.

You could open an item not received dispute and by going through the proper channels forward the emails to ebay for abuse. I doubt they will suspend him for it, but his Policy Compliance will get hit and if repeated issues arise, they will kick him off ebay or suspend him from selling, etc.

They will suspend his account "and" any other account's in his name (if his brother uses his Paypal or happens to live under the same address- "BAM" suspended)! I really dislike shadiness such as this. I have a hard time neg'ing, but this is BS...so you really need to ask yourself if this is worth any possible retaliation's or headache's in the future as you- not any of us- will be the one to have to deal with it; if you don't mind the possibility of such then I say NEG the hell outta him! :D

I just contacted ebay, sent all the info that I have. Hope to hear back soon. Also filed an item not received dispute. I haven't dropped the negative yet. We will see what happens. I am going to give him a neg if I don't get the card for the original amount.

You need to do more than email eBay. You have to call them. They will suspend the guy though.
