I'd maybe try and settle it between you and the other guy first, if not.....................

How would you do that in a non threatening way? Do I mention going to the police if he doesn't want to work it out?

I had a lot of around 2000 + 2010 bowman draft chrome/base cards.. stated it was mixed and no big names had been pulled. Sold the lot for $300. Guy complains that there wasn't enough stars in it, when I had listed what # of better players cards were in said lot. Guy says he wants a full refund .. I say, I will give partial because he's not happy .. He counters with I want all my money back. So I tell him, send the box back, and I'll refund. Buyer says no and states I must refund money and they keep the cards.. I get a 2000+ ct box a week later with a bunch of 1990s junk. File a claim and take pictures and whatnot, buyer disputes my claim back. And paypal follows with a negative mark on my ebay account, and seller gets money back.

UPDATE:

Got an email from Paypal asking for additional information. I have to either go get a police report and fax it in or fill out a form and have it notarized. I will be doing one of these out of principle but should I try to contact the member first and see if he has changed his mind on how he wants to play this or just keep it all on my end until I hear otherwise.

So Paypal is basically asking you to list them, along with the buyer, as the thieves in this police report? After all, the buyer only stole your card, it was Paypal who has now stolen your money.

Not really upset at paypal in this. They did what they do in every dispute, I wonder how often something like this happens though. I see a guy a few posts up has had a similar issue but I was thinking a lot more members would have something similar to chime in about.

I would tell him I received the package but you did not include the correct card. THis gives him the option to resend or deny it . If he does not respond or denied doing it, tell him you suggest you please look again to see it he did in fact send back the wrong card as you will be reporting this to paypal and the proper authorites.

I read a story once about a guy selling a $300 card and the buyer changed his mind. Guy sent the card back with all the tracking info. When the seller opened the box it had a brick in it. I don't think he ever got his money back. I sold some childhood toys a few months ago. Listing clearly stated they were well played with. Posted four different pics. I received a message after they were delivered saying that some were dinged up and they didn't want them. I refunded the money. When I got them back, only about half were in the box. Paypal did nothing about this. I feel your pain.

In your listing and on the sold items page there should be a link to "report buyer" on Ebay. Also, tell him that what he did is considered mail fraud. Every time I've mentioned mail fraud to someone trying to get one over on me they comply. :D

wow that's crazy man....really hope this guy gets the perma ban from ebay/paypal....but knowing ebay, this doesn't effect their bottom line, so I fear that the buyer will win.....

Ebay protects the buyer, they want buyers to feel safe...the seller is just the necessary evil :(

Best of luck!

Just Kidding,But,this is the kind of things you can do and win with paypal...they dont care about Fairness!!

For those following the case:

Called Paypal again today and according to them if I file the police report and have it faxed I will automatically win this case. So after lunch it looks like I will be heading to the police station. Will have one more update after this to confirm that I got the money back or not.

Good luck! Hopefully Paypal follows through with it!

Not holding my breath. I called them to make sure it was worth my time going down there. Told them others have had this same deal with no luck on their side. She told me since Paypal asked me to do this that they were on my side and all they needed was for one of the two options to be done.

And a WIN! Got my money back about an hour ago. This morning they said they would be taking it from the other guys account but with the paypal message they may have just gave me their money...

As a one-time goodwill gesture, we have issued a credit to your account. We appreciate your business. Thank you for using PayPal.

Hopefully that is not the case because then the buyer still won but I guess I have my money so it doesn't really matter to me.
