Ebay situation. What would you do?

Recently, I bought a card of a particular player. The card was up along with maybe 50 other prospect and young player autographs. Every card had a scan attached to it, usually they were gang scans were four of the auction cards were in one large scan and the appropriate scan would go with the according auction. This specific card did not have a picture to it. The card that I bought has an autographed version and also a non-autographed version of the card. In the description and the title there was nothing about it being autographed, but in the categories it did in fact say autographed. I took the chance on the card just thinking that it could be autographed and I would get a nice card to complete a rainbow. I asked the seller if the card was autographed before auctions end without a response, I then proceeded to win the auction for a nice price. Fast foward to today (a week later) i wanted to check out why i hadnt received the item yet, I went and checked the sellers other auctions and I saw my card (in fact it was autographed with the exact serial number that mine had listed) It had been resisted for two days already and already had a higher bid than I won it for. I emailed the seller asking what was up and I got this response..

sorry for the no explanation.... but when a $100 card does $10, the listing was obviously wrong. The picture didnt match the title, thus no one knew what they were buying....i can say i meant to sell the $1 card in the picture.....

I had to resell it because i need the money. But im in it for $125- im not taking a massive hit because you want a too-good to be true deal. Im sure you know this.

Am I sorry and sympethetic. Yep. Will I do something for you? Yep. I'm just gettin killed at my job (in commodities,) been sick with the flu, and havent contacted you. I will refund your money and let you pick a medium priced card for free. Do you think this is fair?

As I was reading I figured he'd screw you and run, but I'd just take the free card and not cause a bunch of crap.

It's one thing if he contacts you first and explains - then I would have some sympathy. It's just ignorant of him to relist without an explanation. If he does in fact do that for you, then he's earned his way out of a negative.

Sent the seller a message back asking for my refund telling her I would be interested in whatever the other card was. That was two days ago without a response. The same card sold today for 66.00. Next step?

File a claim, let it go through, then leave a negative. That's what I would do.

Sure we all make mistakes, but he should have at least been upfront with you. Not your fault he's a idiot that doesn't know how to list. I would contact ebay and turn him in for non-compliance since he figured that he didn't need to keep up his end of the sale.

So anytime a card doesn't sell for what a seller thinks it should, it is a mistake? Mistake or not, he should have contacted the buyer before relisting and explain why. Because the seller chose not to take the high road, I would file a complaint and definately leave a negative. How many other buyers have to be screwed before his supposed mistakes are taken serious. Put this one on the record so it is one less mistake this idiot gets to make.

So shady. I would get my money back and leave a negative.

I'd lower the boom as well. Hey I am broke, lose money on cards all the time, yet always keep my end up. No excuse. They should be more careful then with a $100 + card.
