A week or two ago, I purchased what was supposed to be a 2004 BCDP Gio Gonzalez Gold Ref. Auto on eBay. When I opened the package today, however, I pulled out a regular refractor, not a gold. I emailed the seller asking for a refund, because I clearly did not receive the card I was supposed to. Here is our conversation so far. What do you guys think I should say next? He is being extremely stubborn even though he is clearly wrong. I even left his card in his tamper proof top-loader thing so I can prove I didn't switch out the cards.

Me -
Hi I just got the Gio Gonzalez card I won from you the other day, but it is not the card described in
the auction. The auction clearly describes a gold refractor /50 and this is just a regular refractor. Hopefully this situation can be remedied.
Eric

Him-
you do know they arenta actually serial numbered. the card was a cracked bgs 8 gold refractor auto. if your tryin to pull a fast one im the wrong person to do it to!

Me -
Yes I am well aware that they are not serial numbered on the back, for I own multiple gold refractors and know exactly what they look like. True golds even say "gold refractor" on the back, and the one I received from you does not. I'm not trying to pull anything on you. I just want my money back.

Him -
in 2004 they dont beacuse ive had plenty that havent. just sold a cracked rickie weeks that was the exact same card

Me -
The 2004 autos say gold refractor on the back. I am comparing the ones I own with the one I received from you right now. Also, the one you sent doesnt have the gold refractor tint on the back. It is just a regular refractor that you sent me.

Him -
doesnt make the card not a gold considering it was a bgs 8 gold refrector auto 2 weeks ago.

There is absolutely no way this card came out of a BGS case that said gold refractor. How am I supposed to deal with this guy?

File an "item not as described" through paypal and be done with it. Sounds like the guy's not going to give in. Or, scan the back of an actual Gold Refractor (where it says "gold") and the card you got and send it to him.

Tough call. The seller is definitely being difficult. Your best bet might be to file a paypal claim, and get your money back that way.

You can just file through paypal and might as well since he is either a dick or just trying to pull a fast one. Well he could be totally oblivious but so far his responses are idiotic. I would just end all talks with him.

sounds like the seller is being stupid..just get your money back from paypal, no matter what the seller can not do anything, thats why as a seller if anybody has a problem with the item puchased (even if i know they are lieng) i just give them a refund when i receive the item because i know ebay will side with the buyer no matter what...

Yep. I always chuckle to myself when dealing with stubborn sellers who seem hell bent on being as difficult as possible. I always know how it will turn out... I get my money back and they get negged for being an ******* and giving me a hard time. The buyer is always right on eBay, so that's how you have to play it as a seller.

But . . but . . . then the entertainment would end! Pretty darn funny reasoning on his part--not to laugh at your situation though.

Send him a pic of yours and keep us informed!

what a j-off, file with a SNAD right away, have someone (post office) witness that you are sending the card back, send back insured with tracking (as Paypal will require), get a refund, Neg him for being a dink, and let us know who this seller is!!!!

I would have been filing a Paypal item not received claim right after his second e-mail. Paypal doesn't care that "it was a bgs 8 gold refrector auto 2 weeks ago."

Did you tell him this and send him a scan of the card inside his "tamper proof top loader thing" he sent you? Thats what i would have done at the start. Now i would just do what everyone else said and file with PP.

Could you post a link to the auction, I'd like to have a look at it.

Thanks!
