Is this auction a joke?

I don't find using the Porcello as his picture to be that big of a deal... ESPECIALLY if it is within the eBay TOS. It is definitely not something I would do, but seriously, if someone placed a bid expecting that card, they would have to be pretty dense... that's why there are descriptions. Shady, yes... wrong, no.

For me shady = wrong. Ethics are as important as rules and laws, and this action isn't ethical.

He's not selling a Porcello Orange in this listing... I don't think it is un-ethical, it's simply a selling strategy. If he had no picture at all, would you expect to get nothing if you bid???

The sub-title says "Loaded Lot 2+ Cases Worth Refs, Blues, Chrome + More!!!" and in the description it says "NOTHING was pulled" (in bold). Then he makes the disclaimer (not in bold) that the orange Porcello isn't included.

Okay, so it's agreed that if you read the description (which every buyer should do) you would know that you are not getting the Orange. So I'll ask again, if there was no picture at all, would you expect to get nothing if you won the auction? I'm not trying to argue with any one, I'm just saying that it I don't think what the OP is doing is as BAD as most in here are making it out to be.

If he were selling a Montero, I would agree with you completely. But he is selling over 4,000 cards that came out of the same cases he pulled the Porcello out of... should he have a scan of all of them individually to appease all the ethical perfectionists? It's a flawed and tacky way of getting views on his lot, no more, no less... IMO.

He is selling a base non-auto Montero.

Post thanked. I agree with the "picture of nothing" thing. He does not lie to potential buyers. If the bidders place a bid on his item without knowing, it's their own fault for not reading the item description.

Just ask yourself this: Does he lie to the potential buyers? Does he omit the fact that the Porcello isn't one of the cards in the auction?

Don't think so.

Sure, what he's doing may be upsetting, but calling him a dirtbag is straight up wrong. Sure, you might not want to bid on his stuff anymore, but he's not a dirtbag. What he did may be "unethical", but not wrong. It's his auction, he can put whatever picture on it he wants as long as he doesn't lie to the customers about what they'll be receiving.

I think the biggest beef here is the hypocrisy in the whole ordeal. The OP's original intent was to call out another seller for something equally problematic as his selling "strategy," i.e. unethical to the OP. That's what I find so fascinating - the fact that he's condemning someone else's selling practices while condoning his own, equally questionable tactics.

Wait. Do you think he pulled the Porcello Orange in this case? He didn't, the Porcello isn't being sold.

He obviously doesn't need to scan all 4,000 cards, but the card in the scan, should be one of the cards he did pull.

1) The box I received from Topps was their mistake. I am not trying say to I pulled one over on them, but anyone here would have busted the box that they received. I got the box in the mail, seen a box of Topps Triple Threads...I didn't even see the notice they sent until after I busted it. The notice said they sent this as a replacement for the RED Frazier I redeemed. As of that date, I never redeemed a Red, only a Refractor. I would have busted the bust either way and 95% of everyone here would have to. If you wouldn't I guess you are a saint.

It might be hard for you to believe but there are a lot of honest people that would have contacted Topps. Me being one of them. Hell there was a guy back on Beckett that recieved two of the three Ruth Exquisite Jerseys when he was only supposed to get one. He contacted UD and made it right. Being honest really is not that difficult.

Ditto. Got a gold status EEE auto /5 from donruss in 2007 when I was supposed to get the /50 version. I was tempted, but after a couple seconds I got on the phone. They sent me a box just for being honest and I mailed the gold back to them. It's not hard to do, and you'll feel like crap if you aren't honest

Anytime you have to make a point in the auction stating you are not receiving the card pictured something should click in your head that you are doing something morally wrong. Some people couldn't care less though.
