Is this not against some eBay rule?

I am seeing an increase in the amount of people listing their items as an auction style listing with bids and at the same time running a buy-it-now to take offers on the same card.

Is this an acceptable practice?

It is not allowed by ebay. I report the auctions because it clogs up my searches, it seems it is always some overpriced card nobody wants.

What I've done in the past is wait for the auction to finish... and offer an amount slightly high via BO. I did it to test the seller. Will he honor the auction price... or take the price of my BO. When they accept my offer I let them know my offer shouldn't factor in because the same exact card ended at auction for a lower price. And since it ended before my offer was placed... you should have canceled my offer and sold it to the guy who won it via auction. The seller can't give a negative.. so all he can do is cancel the transaction and hope the original buyer will still honor his bid.
