Re: Pissed Right Now ebay deal

Right now there is a guy typing away on another message board or telling his friends, I paid $600+ for a graded Jay Bruce card and some jack-ball sent me an empty envelope.

There are two sides to every story and then whatever happened to the package as it was handled by countless postal employees. I wish the OP the best of luck with his/her paypal case.

There really is no sure-fire and cost effective way to protect both the buyer and seller.

Re: Pissed Right Now ebay deal

After 15 years on eBay, I've had one bad transaction. I bought a Dale Murphy bobblehead for $30. It was taking forever to receive the item so I opened a case. A week or so later, I got an envelope in the mail with delivery confirmation. Inside the enevelope was a $1 bill. I lost the case becasue the seller was able to prove delivery confirmation. Obviously I didn't receive what I paid for, but PayPal didn't care.

I still don't own that Dale Murphy bobblehead.

its getting to the point where you will have to videotape yourself putting the card in the bubble mailer and securing it with tape over the sealer etc.. and also take video of said package being dropped at the USPS in order to even have a chance of winning a claim against Ebay/Paypal when a shady buyer screws you and the system.

Or you just purchase insurance, as that is your protection.

Do you really think eBay or Paypal is going to give two ***** if you provide them video of you putting a card in a bubble mailer and taping it shut. Then you turn off your camera. Then you drive to the PO and turn your camera back on when you get there and either drop it in the mail box or handing it to the postal worker. What happened in that time between taping it shut and getting to the PO? Prove to them you didnt open it back up and put something else in there or emptied the contents out. See you can poke holes in everything. Just buy effing insurance and call it a day. If a buyer claims non-receipt or an empty package, then you are protected and can go from there. No insurance and you are ****** no matter what!
All we know is that the op said "he signed for it". I would suggest the OP confirm that the buyer actually signed for it.

If the post office allowed anyone other than the name who is on that package to sign for it, then the post office is responsible and in the wrong and the seller is off the hook. Anyone other than the name on that envelope who signs for that package and takes possesion legally constitutes theft of mail.

Uh, no.

every package that comes to my office is signed for by the receptionist, despite my name being on it. I've had registered, insured, sig confirm, USPS, UPS, you name it. Never have I been summoned to the lobby to sign for a package.[/quote:1z3beyz0]

Same here.I used to have cards sent to the office, and the receptionist always signed for my mail.Never was misplaced.

I just don't like the fact that the name on the mailer and signature are not the same. Your card could have made it to the address. What if the person who signed for it stole it? Why should you be liable for that?

Re: Pissed Right Now ebay deal

I had a similar story years ago, before eBay started their "buyer protection" crap, and on a smaller valued card.

Thankfully, I used signature confirmation/DC on most of the items I was shipping at the time and got a claim filed saying the envelope arrived empty. If I remember correctly, I did not use insurnace though.

PayPal ruled in my favor and his claim was denied because the buyer signed for it.

In a similar story, I sold a 2003 Bowman Heritage Delmon Young Auto RC years ago and on the 44th day, buyer filed a claim saying the card was "damaged" and he didnt want it anymore. I argued with the pos for at least two weeks through PayPal. After getting tired of arguing I called Paypal and asked them what they thought. Long story short, they told me just to refund him because chances are I would be ruled against. (At least they were honest :/). So, I did just that and eventually sold the card for about $40 more than he paid. So it worked out alright in the end for me there.

The point of that story was that the time usually doesnt matter. Mine was filed 44 days (1 day before the cutoff to file a claim) later and I was told I would be ruled against because he had a scan of the card having a nick in the corner of it. I would say the OP is SOL in this situation especially with eBay's increased buyer-loving rules. Had ths been 2 or 3 years ago I would've said he had a shot at winning but no chance in hell now.

Is it not possible the buyer didn't actually receive the card, that it was opened along the shipping lines, the card removed, and arrived to the buyer empty? It's instinctive to want to blame someone and to automatically label the buyer as a thief and a liar, and the buyer is the easiest way to accomplish both. But geez, can the guy not be telling the truth? He has a lot of feedback and it's all positive. I'm not at all saying that he didn't scam the OP, but I'm also not at all saying that he wasn't a victim either.
As to, "WTF AM I SUPPOSED TO DO?", the simple answer is "insurance".

So let me get this straight...

I can sell a BGS Gem Mint 9.5 Michael Jordan RC card for say $1000. Package and ship, (with insurance), to the unlucky buyer an empty BGS slab. After the buyer claims the card was not in the package and demands a refund, I can refund him with the post office's money?

I'm having a hard time believing insurance is "the simple answer" you claim it to be.

I agree with Solt. I see absolutely nothing wrong with letting the buyer know that you will call the local authority as well as his Post Master and have them investigate further. That is of course, if you did in fact mail to him as you say you did. For all you know, either he is committing fraud, or someone in the post office committed a federal offense. In either case, the authorities and/or the USPS will want to know about it.

1. You really should continue to get that legislation outlawing cut autographs passed.

2. Insurance fraud happens ALL THE TIME. If my house burns down, and I claim that I had a complete 1952 Topps set with 10 different PSA 5-8 Mantle RCs, I open myself up to insurance fraud. The purpose of buying insurance is to make sure you don't have losses at the hands of others. You fill out the claim forms and the recipient fills out the same form. If you can prove that the USPS caused the loss, you get reimbursed.

Try it 2-3 times, you get thrown in jail.

1. You don't pay very good attention, do you Jeff? It's pretty hard to "continue" something that I never started. I knew you'd bring this up as another attempt at smoke and mirrors...something you're good at doing. My stance on this issue is still the same. Just because you disagree most definitely does not make you right. It's comical that you're having such a hard time getting over a simple post I made a long, long time ago...one that my stance on has not changed.

2. I never said insurance fraud is rare. I simply stated that your "simple" solution is NOT as "simple" as you're portraying it to be. Disagree with me all you like. It doesn't matter.[/quote:qmotszqs]

1. Whatever, Honyltd.

2. Let's say I received this card shipped wonderfully. THe card was pristine when it got to me. But not insured. And I want to be a scumbag and claim that the envelope was slitted open and I didn't get the card. If I see that this was insured, I'm a LOT less likely to file a claim because I need to swear and affirm to the federal government that it was not delivered and that the card was lost. I'm a lot less likely to file the claim because, eventually, I want to sell this card. The government is watching, and if they see I sell this card after I filed an insurance claim... I'm going to jail.

If there's no insurance claim and I'm just screwing over some random seller... I can sell the card locally or on ebay in the future through another ID and there's little way that the seller, without any real power, can do anything about it.

So yes, purchasing insurance is really an easy fix.[/quote:qmotszqs]

1. Typical response when someone realizes they are wrong and has nothing better to say.

2. You're being pretty presumptuous. I doubt even 5% of the ebay scamming population would think of it in your terms above.

So no, I don't believe purchasing insurance is the easy fix you are claiming it is.

Can anyone tell me what Amazon does when a buyer claims to have received an empty package? I'm curious to find out.

I hate to start a thread about eBay so I'll use this one...

Anyone here deal with Officespace24?

Sucks that you can't leave bad feedback for buyers... hence the 100 percent positive on only a fb score of 16.. yet half the comments on the feedback is that the guy doesn't pay. So after five days of accepting this offer, I'm thinking this clown isn't going to pay me either.

But 100 percent awesome buyer!!!
