Make sure you get signature confirmation and maybe insurance. How's the sellers feedback and do they list a return policy in their description?

I'd File through paypal and do it that way. If you send it back and he doesn't refund he has tracking to show his item was delivered....

File a dispute with paypal and go from there. If he doesn't give you a refund ASAP, escalate to a claim. Afterwards, paypal will side with you (I'd be shocked if they didn't), they will instruct you to send the item. Since the item is over $250, you will be told to utilize signature confirmation. Once the guy receives it, you'll get your money back (if you are expecting to get it back the day he gets it, don't; you won't). You'll probably have to wait a week after he receives, but you'll get your money. Much better than just sending it before agreeing to a refund. Or agreeing to a refund without PayPal/EBay aware of it.

I actually would have done it the way you were originally intending to do it. If you send back with sig confirmation and the seller claims he never got it, you could always open the dispute later and already have the tracking info. It would piss me off as a seller if I offered a refund and the buyer opened the claim anyways because my paypal account would be frozen. By opening the claim, you take the matter out of the sellers' hands. Because you opened the claim, he can no longer manually refund your money. You'll have to wait for paypal to decide the case, which could take a few weeks.

PayPal will instruct you via email, or you can check every day or few days in the case under open cases in the last 50 days in the resolution center in your paypal account.
