Hey all --

You might remember this thread in which I told you all about a Brett Lawrie Razor Silver Auto (#1/5) getting lost in the mail:

Guess what - it just arrived, 24 days later.

So before I inform the seller of this news, I wanted to make sure I'm doing the right thing.

When we both assumed it was lost, he told me he was going to file an insurance claim with his PO after the required 21 days.

Assuming he got reimbursed by the USPS already, am I still required to return his refund (i.e. paying for the card)?

Never had this happen before, so I need advice, and fast. Thanks, all.

PS - I'll have a scan when I come home tonight.

I guessing many will say... 'if you got the card and it didn't cost you anything its stealing blah, blah, blah..." but IF the seller was reimbursed by USPS I say you chalk it up to letting the government (usps) buy you a card for their years of sub-par service. Of course if the seller didnt get reimbursed ya gotta pay the guy. Congrats either way!

I would still reimburse the seller regardless. He will probably not get his claim paid if the records show that you received the card.

if the card shows delivered (has to have DC for insurance right?) then I;m sure his PO will be contacting him if his claim already went through. I'd send him a preliminary e-mail asking if his claim was successful.. if he hasn't filed one or it was not, I'd pay him.
If it has, then I'd let him know that it was delivered and suggest stopping the claim.. then paying him.

Except that if a claim is filed for a card "lost and not delivered" and the card is delivered... that would be mail fraud.

Edit to add:

Mail fraud for Jaypers. The seller did what he thought was right. It's actually Jay's responsibility to let the seller know and to pay him since he received the card. I don't think a federal mail fraud charge is worth it for the card.

don't really know all the details other than reading this particular thread, but if it were me i'd contact the seller stating the card arrived and that i would be sending payment. peace of mind and nothing to worry about - then you move on to the next situation.

He didn't use DC, but the USPS can still track it.

I'm thinking the seller would have to return the money to the USPS if they already reimbursed him, no?

Thing is, you can file a claim starting on the 21st day. I got it on the 24th day. This is what's leading to some of my confusion.

dont mess around here, contact seller, tell him to cancel claim and everyone is happy.
there is no way he got paid yet, those things usually take at least a month.

No way post office settled claim....just repay the guy and have him cancel the claim...also post office should contact you

Thanks, guys. I was 95% certain in this case. I just contacted the seller and asked him to cancel his claim, and that I'll pay him for it once again.
