I heard rumors from two seperate hobby sources today that UD is fixin to take MLB, Topps or both to court over the Topps exclusive. This is very similar to what Fleer did in the early 80's, and Fleer ended up bringing down a Topps' monopoly that existed for decades. Seems to me there would already be a precedent (sp?) set.

Any resident attourneys here? JN?

But its ok for Upper Deck to have the exclusive rights to NHL cards???

I don't do antitrust stuff, and don't have the knowledge of the 1980 Fleer - Topps case to see how it applies. Given the fact that UD has the MLBPA license, they have every right in the world to produce baseball cards. Therefore, I would assume the monopoly doesn't exist.

Bringing this into real world, every day vernacular... is Pepsi going to sue McDonalds? McD's has a choice as to what to serve in it's restaurant -- Pepsi or Coke products. They chose Pepsi. MLB has an option as to who to sell a license to -- Topps, UD, or Panini... they chose Topps.
