I sold a 1 of 1 Alexi Casilla, recently on ebay, the buyer received the card and said that it was damaged, (i shipped in a bubble mailer and a top loader) He said that packaged was mangled and he said there is no doubt that the damage occured while shipping, however he is not happy with the card now. I shipped the card mint and protected it as best I could. Also my variable in this problem is that I sold the card for a customer of mine and he has been paid. Should I issue some sort of refund? or say tough luck I did my part? or something in between?

1) How much did the card sell for?

2) Was insurance purchased by you?

3) I may have more questions based on the above answers.

You will have to offer some kind of refund. If they file a Paypal dispute, they will win. So I would try to get them to settle for a partial refund.

I don't wanna sound too *******, but this is what insurance is for. If you offered it and he didn't take it, HIS fault. If it got damaged before it got to him, then you need to rectify the situation. The transaction is not complete until the buyer has the card.

I'm sorry dude, hope it wasn't a HUGE deal.

Why didn't you wait to pay the customer till the buyer was satisfied?

Depending on the ending price of my sales, I dont even make insurance an option. I either have it mandatory that the customer pay the full amount of insurance, or I split the cost of insurance with them, or I pay it all myself. There is NO way I will get ****** over by the PO or a customer claiming damage or "lost" item.

Moral: If you dont buy insurance, you are setting yourself up to get screwed, in a bad way.

I'm on the line about that. I completely agree with what you say and I see it all over eBay. However, at the same time, it IS the responsibility of the seller to make sure the item gets there in a timely manner and safe. With it being a 1/1, I probably would have went out of my way to get insurance anyway to cover my rear. I would offer a partial refund and go from there. You don't want a dispute because the buyer will more than likely win.

So I would asked the buyer for pictures. and then maybe ask for the card back as well.
I had a friend of mine sell a card to someone and then mailed it out
Guy says to was damaged in shipping, so he refunds money and then
one day he is at a show out of town and sees what looks like his card
and sure enough it was and it was fine. So he asked the seller where he got the card
and he tells him a regular customer sold him the card. Man was my buddy pissed.

Needless to say he bought the card and now as it.
I can't really remember what the card was but I know it was a low numbered
card of a HOF player.

Why would anyone ever send a refund without getting the "damaged" item back!?

It's a very tough call and I feel for you. I recently sold a card for 70.00 and sent with DC but no insurance. I tracked the package and it was received by the buyer. I got an email the day after receipt asking about how I packaged the card. I answer and he writes back that the package was opened and the card was missing. I sent the card in a hard case inside of a bubble mailer and did everything I was supposed to do. But, because the buyer didn't get the card and was upset I refunded half his money to help out. I still don't know if I trust the guy as this hasn't happened before but I felt it was the right thing to do. He may be thinking the same about me and still be pissed thinking he was robbed of half his money. It's a judgement call and that's what I did.

Your situation is different in that the card is still a 1/1 and still valuable in that respect. But, because the card didn't get there in the shape it should have you as the seller should bear part of that burden. Not all, but part. You still did what you were supposed to do and unfortunately the Post Office dropped the ball. I'd definitely ask for scans of the card to ascertain the extent of the damage then work with the buyer on a partial refund. If he's amenable to that then great but if he balks at that notion then I'd just get the card back and issue a refund upon receipt. Again, the card is a 1/1 so it holds a value that another damaged card wouldn't. You may not get as much but you'd still command some sort of premium for the fact that it's a 1/1.

Weither right or wrong, it's always the sellers option(and responsability) to ensure proper delivery. Not sending with DC and insurance on anything remotely valuable ($25 or more) is foolish to me. There is no other option here but to accomidate the buyer as he sees fit. I would tell him to return the damaged card and then refund, in full plus his shipping expenses, once the item is recieved.

This is a tough lesson, but one that was easily avoidable.
