Well I've read the recent forum about montourcardshop8zyp viewtopic.php?f=2&t=113189&hilit=montourcardshop8zyp and of course he was the winning bid of my first Albert Pujol ever listed. And his response was the same, sent to my person email account, not through EBay. :evil:

"We won your 2001 Topps Chrome Albert Pujols. We just paid you IMMEDIATELY via (PayPal) like you requested so in your listing. So could you PLEASE "throw-in" some cheaper ALBERT PUJOLS cards for my (2) little grandchildren? Thank you, GRANDPA RON."

Keep in mind, montourcardshop8zyp's response was not through EBay.

Well this morning, what I pretty much knew was going to happen, happened! montourcardshop8zyp placed a claimwith PayPal first saying that he hadn't recieved the card probably because I didn't send any extra cheaper Albert Pujols cards for his grandchildred. Sorry Pal, your grandchildren can buy their own!!! Well after submitting the claim as not recieved (4 days after auction) he changes it to damaged and that he wants to keep the card bu what half his money back. here's what he wrote to PayPal:

1/10/2011 10:24 PST - Buyer: We received the 2001 Topps Chrome Albert Pujols RC#596 TODAY in the mail. However, there is a chip out of the TOP BORDER of the card? This was NOT described in the auction on EBAY? We will keep the card to sell to a youngster here in the store for a REDUCED PRICE, OK? However, we do NOT feel the ORIGINAL price of $30.04 is a fair price. We will be willing to accept a "PARTIAL REFUND of $15 and hope we can get our money back for this DAMAGED CARD? Sincerely, Ronald Aderhold of Montour Baseball Cards (P.S. after we see our "PARTIAL REFUND" back in our (PayPal) account we will be OKI with closing of this case)
1/10/2011 10:24 PST - PayPal: Buyer switched and escalated this dispute to a not-as-described claim.

Here's my response to PayPal:

The card was described under the caption as "good" condition. The payment recieved of thirty dollar is well under the going price for the Albert Pujols Topps Chrome Rookie card he recieved. In all my actions it is "as is" with "no returns" therefore I get numberous email asking the condition of the card. On this actuall card I did recieve another email before the actions end from another interested buyer asking about the condition, I replied to him that the card had chipping on the top. I can provide that email and response with a time stamp showing that I am a honest selller. Also, I feared this was going to happen due to the buyers rep on Freedom Card Boards' Forum. A recent topic was discuss regarding this buyer on how he pays quiclky and then asks for additional free non rookie Albert Pujols cards in addition to his purchase so he can give them to his grandchildren.....this never happens due to reports that he sells the extra non rookie Albert Pujol cards is Lots after recieving them. Also it has been discussed that if you do not send extra cards the Sell get bad freeback for him. Sorry, but it's your own fault. Who cares that you responded to another buyer about the damage? Your description says absolutely nothing about it. That is deceptive.

Further, the other thread does not say he retaliates if he doesn't get free cards. Not sure why you'd even bring that up, to be honest.

PS - If I were sending an email to Paypal regarding a case, I'd at least be sure to use proper grammar.

Sorry, I am siding with the buyer as well. If you knew the card had damage, list it in the auction if you have nothing to hide. I don't think the buyer is 100% honest, but you apparently aren't either.

I'd side with the buyer as well. Although I'd request that he return it so you can list it with a better picture and an honest description. You'll likely get more than you got the first time just by being honest about it's condition. It's a pretty tough card and from what I recall it came out of packs quite often with chipping since it wasn't really a typical chrome card just basically a foiled up Topps card. I've sold a lot of off-grade cards on eBay and quite often, especially on the rarer cards, you get more than you expect just by letting them know what to expect when they receive it.

The buyer isn't completely wrong here.

Your listing included:

Good: An item in used but good condition. May have minor damage to jewel case including scuffs or cracks, or to the item cover including scuffs, scratches, or cracks. The cover art and liner notes are included for a CD. VHS or DVD box is included. Video game instructions are included. No skipping on CD/DVD. No fuzzy/snowy frames on VHS tape. The underlined text above leads me to no further description in your auction...not to mention that above text describes CD's, VHS/DVD's or video games. Why is it part of a baseball card auction?

Additionally, the picture in your auction is terrible.

I would tell him to send the card back and offer a refund of the auction price.

The buyer should be able to see the "chip" from the scan. Sure, it's a crap scan, but it certainly looks to be in "good" shape and nothing more.

This guy runs a card shop, knew exactly what he was getting and exactly how he was going to proceed once he received it without his requested extras.

Easiest solution here, provide a full refund upon receipt of the returned item. Bid on one of his items and give him a negative for good measure and perhaps set up a few automated calls to buzz his cell phone during the 12:00pm-6:00am range. Sure, it's silly and childish, but so is eBay.

To the OP, a bigger scan would eliminate the guessing. For me, I don't physically describe anything that is clearly visible in the scan.

Not sure how you can say anyone should be able to tell defects from a scan, especially this particular one? Scanners pick up all kinds of stuff that look like defects at times. Any noticeable defects on a card of this value should have been stated as such.

The bidding showed that it had a defect, but it doesn't matter, it should have been described as such.

You better contact PayPal quick and offer a full refund for a returned item, or else they may just give him the partial.
I'd also forward them the email from the buyer about the extra cards.

I don't see an email listed in you auction, so I assume people asked you questions via ebay? If that were the case, you had the option to show those questions and your answers. By choosing not to do so, you clearly wanted to hide the fact that the card was damaged. At least in my opinion.

This buyer has been playing the same games with people for years now.Just offer him a full refund and move on.It isn't worth the forthcoming headache.

You need to learn a lesson from this and amend your selling practices.

IMO, this guy is a crook. I couldn't believe he was actually doing this so I called him on a whim to ask him. He went ballistic, stating it's not **** Germany and he's allowed to ask people for free cards. He's a perfect candidate for being banned by eBay. I'd like to see how many problems he's had with sellers.

He does own a card shop, and it's not hard to find it if you'd like to ask him about it or maybe you'd like to place an order with him. If you'd like to reach him, he actually lists his phone numbers in his auctions.

I'd have him return the card and you'll refund him fully including return postage. Eff him.
