I had the unpleasant experience of going to the mailbox today and finding a package of mine ripped into and the contents missing. The item was purchased on ebay and the seller mailed the card in a white padded envelope along with paypal shipping. I have never had any experience like this before. Do I have any type of recourse at all? I contacted the seller and informed him of the situation. The envelope was not "destroyed" or ripped into by a machine since the envelope is still very well intact except for a rip just large enough to remove the card from. I am very disappointed as the missing card is

The card is numbered 9 of 35, if any one ever sees the card available please let me know

Any ideas of what I should do? Should I file a claim with paypal even though it will show the item as delivered? Should I ask for a refund? Should I file a complaint with the post office? It all seems a little pointless as it was not the seller's fault the card is gone.

Edit: I have never had any issues whatsoever with my mail carrier, I have ever had an envelope be ripped in half from a machine and the carrier brought it to my door to ensure that it arrived safely to me and apologized for the whole situation.

I would keep all of your info regarding your buy. If that card ever hits the bay, you got him.
As for the seller, you can't ding him for someone stealing your card. I would definately go down to the P.O. and file a complaint.

Seems odd a carrier would deliver an opened envelope. I'd contact the PO and let them know about it.

I would find out who living in your neighborhood collects cards and knows that you do as well.

I would go to your local PO and file a complaint. It might not do anything immediately, but if it is someone from your PO/Sorting area that is stealing, your complaint might start an investigation that will either get the individual caught or make him stop. I don't think i could do a charge back on the seller, as this sounds like it has nothing to do with him.

If it was a neighborhood thief, wouldn't they just take the whole envelope? I cant see a neighbor standing there ripping open the bubble mailer just enough to take the card out, then putting the empty envelope back in Chavezcollectors mailbox? But then again, criminals have done stupider things.

I am sure he risked his livelyhood for a silly $10 card ::facepalm:: Maybe if it had a label that said greater than 200 insured for STARTERS this would be plausible.

True, criminals have done dumber things and in their minds it might make sense in some twisted way. In any event, it was just another avenue to explore as one never knows in today's world.

that sucks. who knows where it happened. maybe the seller did it. maybe the carrier who picked it up did it. any one of the processors could have done it. maybe the delivery carrier, maybe a neighbor. it would be impossible to trace. thats bad it happened to you. its worth filing a USPS claim, although they will most likely accuse you of opening it.

Why not? UPS drivers do it over 20.00 baseball bats all the time.

That line of thinking is pretty naive. No offense. People steal for ridiculous reasons, not just based on value.

The above scenario of not knowing who did it is why I would file through Paypal. This may suck for the seller but how do you know for certain that it wasn't the seller?...You don't! Did he insure the item? If so then he'll be covered in the long run & won't lose out, but if not then isn't it the seller's responsibility to make sure the buyer receives thier item in the same condition as advertised?...Which I'd say not receiving the card is definitely not the same condition as advertised!

You received nothing for your money & deserve to recover your fund's through the Paypal process, if the seller insured the item (which is what insurance is for, the seller) then it may be a headache but he should receive his fund's in the long run with your help through the PO Insurance claim!

Good Luck, Dave. :D

My postal dude delivers about 20-30 packages to me a week. The ones that say INSURED on it I am sure are much more interesting than others.....though that is not always the case.........so if he was going to take a chance on losing his job, probably on one of those packages.

It just takes 2 complaints for him to lose his job.

1 strike against him already.....hope he enjoys his $10 card and now has to be very careful he doesn't get accused of something next time that isn't his fault.......might get fired next time for no reason.

BINGO!!!!

To the guys that are saying it was maybe the seller, would an empty envelope with a hole in it make it through all the process's without being marked damaged/missing contents? I highly doubt it.

It can happen as the PO's "check's & balance's" is far from a flawless system.... & regardless of if it was the seller or not the fact that the buyer didn't receive what he/she paid for is the main concern for the buyer & Paypal alike (seller should've insured the package).

My guess would be neighbor kid. 1. If the mail man did it, why even deliver the package? 2. If someone else in the P.O. did it, the carrier likely would put a sticker on the package saying damaged or something like that, had it happen before. I bet someone in the neighborhood noticed you getting multiple packages weekly, and decided to take that one. I don't know though, I guess they would have swiped the whole package as well? This is confusing?

I had a card stolen from my mail, and the bubble mailer was marked with a DC tag, so whoever took it made sure that the mailer made it to me, so the delivery was "confirmed". It was a Bobby Orr jersey card from the In The Game "He Shoots, He Scores" program (the thief was nice enough to leave the letter in there telling me what card was SUPPOSED to be in there) - I collected all those points for nothing. I was pretty pissed, but in the end there was nothing I could do about it. The next time I redeemed one, I called ITG, and told them I was including cash for them to insure it, and they did. Of course, the Alexei Zhamnov card makes it to me....

Agreed. Mail Carrier handles a lot of mail. People have no idea how much mail they carry out. All they want to do is get it delivered. They just quick glance at address and deliver it. Most of stuff is machine sorted. They don't examine every letter or package. They just want it delivered and move on.
