Are you protected as a seller on eBay when you bought DC and the tracking shows the package as delivered, but the person claims to have not received the package?

I intend to call the post office during hours tomorrow to see if they can tell me anything, but if they aren't helpful I'm not sure what to tell this guy. He says he thinks it may have been delivered to the wrong address.

Any ideas? And am I protected as a seller by the "Delivered" status of the tracking number?

I just wanted to bump this for an update to the original post and another quick question.

He claims he still hasn't seen the package (it has now been a week since DC says it was "delivered") and has asked for a refund. Obviously I have to say no, but once he opens a case as I'm sure he will, is there anything special I need to do to make sure I don't lose?

Also, if I get a negative feedback over this, is there anything I can do about that? It's not the end of the world I guess, but it kinda would suck to lose my perfect feedback over a package that shows as "delivered."

Yes, you are protected. Hopefully the other person who accidentally got it will put it back in the mailbox for it to be redelivered.

You are protected as long as the item is under $250.00. If the Item is over $250 you must purchase signature confirmation to be protected. If you send an item that cost over $250 with just DC and the buyer files a claim 9 times out of 10 you will lose the claim and the Buyer will end up with the card and money back in his paypal account. Sucks but those are paypal rules.

When does the package state it was delivered? I have had a few instances where it says delivered on USPS and it wouldn't actually reach my mailbox for a couple of days.

Same thing possibly happening to me on ebay. Say what ATH said happens and I put insurance on an item and the person never "go it". The insurance was $250. What would happen then since the $250 card would not be in play. i would need the $250 from the insurance but the other person would also need a refund so that means that I would gain $0 and lose the card?

Looks like the morning of 5/2 was when it was delivered.


Thanks for the help guys. Item was about $50 so sounds like I should be ok. Hopefully the card turns up for the guy.

I believe everything over $200 insurance automatically requires a signature for delivery. So you should probably be able to figure out if he signed for it or not.

you're forgetting the $250 the guy already paid you in your equation

Buyer pays seller, seller has to refund, there is a $0
Seller gets insurance $ from the PO, seller has their money for the sale back
So you still get all of your original $$$

Same thing happened to me over a $100 card. I didnt want to lose my 100% feedback so I ended up working something out with the buyer. Long story short is to Always use insurance for higher valud cards

Insurance would come into play only if the package shows as never having been delivered. Yeah it's unfortunate since I obviously did my job as a seller but I'm not real worried about it I guess. Life will go on.

Also, the delivery address has to be a Confirmed one with Paypal. Never ship to an Unconfirmed one. Unconfirmed Paypal address = license to steal.

play some hardball with this guy. Paypal will side with you and if he gives you a negative then just contact ebay to remove it.

They will not remove the negative feedback. This happened to me as a seller and they refused to remove the feedback.

They will not remove the negative feedback. This happened to me as a seller and they refused to remove the feedback.

oh, i guess you should give the guy some money back to avoid a negative then if that is the case.

Arguably, you didn't do your job. Your job as a seller is to get the item to the buyer. The buyer is claiming you didn't; you have proof that shows that you did, however, I think we all believe that the USPS screwed up.

That being said, proving that the USPS is next to impossible.

AS others have said, if you could cut a deal with the guy, that may be best for all involved.

That USED to be the case, not so anymore. Paypal protection is provided for ALL ebay transactions within the US as long as you ship to the address provided by the buyer in their payment details. Unconfirmed/confirmed, verified/unverified, doesn't matter. You only have to worry about unconfirmed addresses selling OUTSIDE ebay.

As long as I win the PayPal claim I guess I'll just eat the negative if that's what happens. It does suck, but at the same time I don't want to lose money on this when it clearly states delivered.


As a side note, the card has gone down in value since the sale by about 10-15 dollars. The guy could be lying due to a classic case of buyer's remorse even though the card DID get delivered to him and he is just trying to get his money back in addition to the card. I really don't know. But since it says 'delivered', I have a much harder time just sending him a big refund than if it was clearly lost in the mail or something.

As it stands, I told the guy via eBay message that since it shows as 'delivered', I can't refund him but that I'd be happy to contact the post office again to see if they could help at all (the first time they just said to wait it out a bit to see if it showed up). I haven't heard back from the guy yet at all, so I guess we'll see what happens.
