Well he began a paypal dispute tonight. I responded to it with the delivery confirmation number and a brief explanation of the situation.

I'm sure it will get there eventually, but is it better for me to be the one who escalates it to a PayPal claim? Or does it not matter?

Well I won the claim after providing the DC# but the buyer opened a second claim now claiming "item not as described" with the specific reasons of "missing quantity" and "time sensitive late". I just provided the first paypal claim as well as the tracking number and responded to each reason separately. From the information provided, I feel that it is very obvious that it SHOULD be decided in my favor, but I guess we'll see after they review the case.

Anyone have experience with one claim closing only to find the buyer has opened a second one!?

I was too, it seems kind of bogus that he can reopen another case...although in addition to providing the case number for the first case, I checked the details of this second case and it has all the detailed information of the first case.

I guess I'm very confident that my response would win a debate, because it is clear that I'm right as long as PayPal honors USPS Delivery Confirmation, but I guess I'm just not sure how they will view this.

To respond to each reason the buyer listed, I basically said that since DC shows the item was shipped and it was only for one card, there's no possible way it could be missing quantity, and since the DC states it was delivered 5/2 (when the expected delivery according to paypal was 5/3-5/4), there's no possible way it was time sensitive late (it was actually a day early).

Of course, that's assuming the DC# is correct, but I've never had a problem with the DC being wrong before in almost 1000 transactions. I suppose it's possible, but not likely, especially when considering the card can now be had 10-15 dollars cheaper.

No; it's a good thing.

Let's say you buy something from me. You open a non-delivery claim. I get off my ass and send it to you. But I send you, say, 1 card out of a lot of 20 you bought. So -- I sent it D/C so the non-delivery claim will lose, but clearly this is not what you ordered. You can open a 2nd claim.

I agree that it's good that this is an available option for situations like the one you describe, but in situations like this where the seller did nothing wrong and where there was only one item in question, it seems excessive because this is basically the exact same thing that PayPal already ruled in my favor. I can only hope that they'll decide in my favor a second time.

I also talked to my own post office today and they said the only possible way the DC# would show delivered and the guy not get it was if it was stolen out of his mailbox, which really shouldn't be the seller's fault or problem...should it?

No. Once it's in the buyer's mailbox, you're golden.
HOwever, you have to assume it made it there. The mailman may have nicked it for himself, or it flew out the window, or was misdelivered....

Yes that's how I feel too...but consider what we know: 1. it states delivered on the tracking, 2. USPS may mess up, but this is a rare, rare occurrence (my postal worker said that this DOESN'T happen, because the DC would not say 'delivered' unless it was delivered), and 3. the card lost about 20-25% of its value since the transaction.

From these three points, logic makes me want to believe the guy has the package but is feeling buyer's remorse. What if NOTHING went wrong whatsoever and the package was delivered promptly and normally, and the guy is just trying to get the card and the money. I guess there's no way to ever know for sure, but this seems most likely to me.

Actually, I'm more willing to believe he didn't get the package.
It's stupid to claim that you didn't get it when DC shows it did. If he wanted to go fraudulent, he would have said the card was damaged or not in the package when it was received.

I have now won two cases for the same transaction and now the buyer has opened a third, this time for "unauthorized transaction".


Honestly I'm starting to feel harassed. Because of the hold PayPal places on the funds for each case, I'm handcuffed until they resolve the dispute even though it has already been decided in my favor twice, which is a real pain in the ass. The tracking says the package was delivered so I will not willingly give this guy a refund no matter what, I just think he's lying or that it was stolen from his box, which is not the seller's responsibility. Is there anything I can do to make this stop?

I would be calling paypal and ask them what more you can do to protect yourself from this a-hole. Clear cut case of abuse of the system. Also what is the ****** face's ID?

And I got a negative feedback from this today (my first).

I guess I don't really care that much but it just sucks that I can get negged after doing my job, especially to spoil perfect feedback.

Edited to add that I just called eBay and the guy told me to call PayPal about the third claim but once that is settled, I should call eBay back and they will most likely remove the negative feedback.
