If this isn't justifiably removed via a motion to dismiss or motion for summary judgment, then Mitch Einertson is in some trouble.

I've always thought about this...Why hasn't there been any class-action lawsuits against Bonds, Clemens, McGwire, etc. Collectors "invested" in these guys and lost most of their investments due to negligence on the athlete's part....

I'm glad the blogger mentioned it in his post, but apparently Mr. Cookson failed to recognize that he made a terrible investment regardless of the name/age fiasco, because Carmona sucks.

I've always thought about this...Why hasn't there been any class-action lawsuits against Bonds, Clemens, McGwire, etc. Collectors "invested" in these guys and lost most of their investments due to negligence on the athlete's part....

Because there's no forseeability on the part of the athlete that you're going to lose money based on their performance. TO have liability, you have to have some idea that what you're doing can harm someone else.

There are 5 or 6 other legal reasons why this will fail, but this is the biggest.

I do agree with Johnny Bench: MLB players who knowingly took drugs should have their contracts voided. Why should clubs be punished financially.

I'm gonna sue baseball america because they said jason stokes was going to be a star.....THEY LIED!

Im also going to sue beckett because they said jason hart was the next bagwell....THEY LIED!

And guess what? I'm doubly suing beckett because they said pujols was the next orlando cepeda. Hes 10x better & I didn't buy more because cepeda was only a good player!

Obviously, this guy has no case against the player, any more than you would have against a player who makes an error costing the game when you have a bet on it. The real target is just as obvious: card companies. When you print this:

Attorneys?

absolutely attorneys are a waste. Too many of them for too little legitimate needs for legal cases. There should be a quota on attorneys such that the number of new practicing attorneys cannot exceed the number of attorneys who have retired, been jailed for shooting the homeless, lost their law license, or have died.

I wonder if Bench took amphetamines like the vast majority of his contemporaries back in the 60's and early 70's.

One correction is due in this thread. This is small claims court in Ohio, so no attorney is allowed to argue the case. I'm guessing that Cookson is filing this on his own behalf, and no attorney is involved on his side.

Cookson said he has been asked to move the case to the Judge Mathis Show on TV, but Carmona and his representatives would have to agree as well.
If so, the show would most likely pay for the outcome..
