Looking forward to hearing what is going to come out of this
I don't care if it is only Wade Miley. When I am told a player is exclusive to a brand and then other brands have cards that pop up, it makes me nervous.
If nobody Miley can do it, what happens when another loophole or instance occurs for a higher more notable player appears elsewhere?
I am beginning to think that I should have used the $1600 I invested in Razor and used it on a collection of Gordon Beckham gold autos.
BG had no problems popping in here when he wanted to answer questions, showcase the product or spam the press plate auctions. I really hope he pops in here soon. I know some are going to say he has a family and blah blah blah but hopefully he can comment on this sitaution in the near future.
He might not be able to give much of a statement right now but something is better than nothing.


Also, I hope future posts do not cause this thread to get locked since this is a very important thread

I skimmed through this thread but have a quick summary question. Has it been detemined if Donruss decided to ignore Razor's contract, or was it a mistake, or is exclusive not really exclusive?

I was thinking of getting another box or two but this could change my mind

You had a phone conversation with BG. He knows there is a FCB thread on the matter. I don't think it is going above and beyond for BG to find a minute or two to mention a few words on the board even if it is "Hey, we will have an answer after we have time to investigate"

Technically he owes the supporters on FCB didley squat. However, FCB has been very good to Razor and a big supporter so sometimes you go the extra mile.

Given the fact that there are no autographs, it seems clear to me that the player broke the contract. Donruss obviously would have no way of knowing there was an exclusive contract; they were somehow notified of same after the cards were produced and it appears as thought hey pulled all of the autographs, doing what they could do to abide by Razor's contract and not put Mr. Miley in any more hot water. The last die cut cards were not pulled out, obviously.

Unless Brian's contract with each individual player called for some amount of liquidated damages (which are damages that are agreed to by the parties should one of the parties break the contract, as it is usually far too difficult to determine actual monetary damages), he is likely out of luck. Donruss had no apparent knowledge of the contract, and for a manufacturer to sue a player is 1) not good business; 2) likely attempting to obtain blood from a cactus; and 3) more likely to rack up exorbinant legal fees and not likely to produce substantial damages as there appear to be no substantial determanitive damages to the 26 cards making it to the marketplace.

If there IS a liquidated damages clause -- and again, understandably, Mr. Gray never was willing to show me his standard contract -- he can possibly sue Mr. Miley for those damages. However, as somehow, it appears as though Miley mitigated Gray's damages by having his cards pulled, and no autos made it to the marketplace, it is possible that a judge may not enforce the liquidated damages clause, since Razor is not exclusive to base cards being in a product, as they were with Donruss, and as they are in Tristar.

This is why the world needs lawyers. Should be interesting to watch it pan out.

I was referring to gilmo and others who said he had signed a contract with don russ and that there was no reason to tk about it any more.....clearly this isn't so cut and dry

There is something everyone is missing, miley was listed as an auto in eee and actually still appears on the checklist but no cards were produced....also there is no base miles from what I have seen. Only /25 and under and no autos....the product has been out long enough that something would have surfaced if he had any other prime cut cards besides /25 and lower parralels

What aren't we getting? Doesn't exclusive mean exclusive? I didn't think it meant that these guys would not appear on anything numbered more than /25.

Again, how do we not know that Razor found out about the contract too late in the development process? The cards were already printed, and auto'd, and put in packs. Signed, sealed, delivered, then this magical contract appears and they can't do anything about it. Yeah, they havn't taken it off of their site, but come on, I've been looking for a sell sheet/updated checklist for UD Ultimate Collection for the past 2 months and the product is live, yet no such thing appears on their site. Things happen.

Regarding the comment that he doesn't like to take work home with him, are all of his comments on FCB between the hours 9-5 M-F?

I doubt if Donruss had a contract with Miley they would pull all the cards because Razor found too late and already packed and shipped his "exclusive autos". He was put on both EEE and Primecuts CL as an auto and nothing has surfaced except for what seems to be 26 non auto'd cards...I think they slipped through production ..

It is too weird that these are his only non-razor cards showing up...

I will be the first to admit that I have not really had much praise for Razor since it came out and while I have not been its most harsh critic I have not said anything positive really.

WIth that said those who are annoyed because Brian spent 2 days off of a message board are crazy. He is on vacation like most during this time.. I'm sure he will be back on monday...

from now on when he does have free time on his vacation I am sure he won't post. Why don't you call him? He has posted his # all over. I think just by the fact that people are EXPECTING him to post things during holiday break is saying how good of a job he has been doing.

It is two things, one he may be on vacation, secondly, every time he comes on here to discuss matters like this he gets torn to bits, it is not like he could come on for three seconds then get off. Gilmo talked to him on the phone, the answer seems pretty clear, if they really weren't exclusive and there was a loophole we would have seen a lot more of this happening with guys who really matter, not just Wade Miley.

Well, he needs to remember that the long this sits the more people will worry about their investments and if they should continue that investment.

He is a new company trying to maintain a toe-hold. It won't take much for him to fall off the cliff.

I'm not saying he must come on here and respond, but he is clearly aware that there are concerns. As happens in the news, no response makes people react with a sense of negativity. I'm not saying it is rational, but he is a businessman and must accept those responsibilities as CEO. Sometimes your job interferes with life.
