“Our motion essentially argued that because he had a designated driver who got drunk that night, it amounts to manslaughter,” Goodman said. “He’s not a murderer.”

Goodman added that Gallo “didn’t want to keep drinking, but other people kept buying him drinks.”

So basically their argument is that it's everyone else's fault that the idiot got drunk. If they hadn't kept buying him drinks, he wouldn't have got drunk. And it's his DD's fault for getting drunk so he HAD to drive.

Sorry, not the way it works. How about taking a little bit of accountability when it's obvious that you ****** up badly?

"But Deputy District Attorney Susan Price pointed out that Gallo had a 2006 DUI conviction and that second-degree murder charges were appropriate under the prosecution’s implied-malice legal theory that Gallo should have known about the dangers of drinking and driving.

The defense claims Gallo was not told about the dangers."

Not told about the dangers....really?! I hate defense attorneys.

Why let the guy off easy? Let him think about the people he killed for the rest of his life. Thats a much worse sentence.

There are some people that truly don't care...

Personally, i think gross vehicular manslaughter is an appropriate punishment for a first-time offender, but not for someone already with a DUI.......and not to mention his sad excuse of a twinkie-defense.

Aside from all that, i still miss Nick.

Killing someone in a car accident didn't seem to affect George Bush's wife Laura, or Ted Kennedy, or Leonard Little and Donte Stallworth. They all seem to be dealing with what they did okay.
