The only thing that will give me closure is a refund of the money owed to me and an apology. I was lied to several times. Coastal had a chance to make it right by issuing me a refund on paypal. Instead, he pretended like he was incapable of refunding me, because he didn't have access to his money. A Paypal representative told me that while he couldn't spend his money, because his account was locked, he sure as heck could still issue me a refund. Mr. Nealey chose to not issue me a refund. The ONLY reason why I do not have all my money back is because I missed the 45 day window to file a claim with Paypal by trying to be reasonable with Mr. Nealey. Other than Mr. Nealey choosing to do the right thing, civil action is my only other course of action to get my money back with. The only hold up at this point is the distance. My dealings with Mr. Nealey have shown him to be a shady, manipulative liar. Personally, I do not believe such people belong on this board or in the general collecting community. I implore Mr. Nealey to prove me wrong about the quality of his character, but in the last 14 months, he has only further demonstrated that my opinion of him is correct.

How much does he owe you?

That depends on how you add it up. He would owe me a lot more in civil court than if we settled outside of court. I never received any of the box toppers from the elements cases, so in court, I would sue for the price of the whole box (false advertising and such). The value of the Elements product was in the toppers, so all I have to show for my purchase is a bunch of junk jersey cards and autos.

Here is what Coastal owes me :

1 Elements case : $266.99
1 Fanpack (purchased as entry into the Ted Williams giveaway) : $21.99
5 E-toppper redemption cards
(1) Cole Hamels autographed baseball
(2) Matt Wieters 2007 Elite RC auto /799
(3) Dwayne Wade Fleer Tradition BGS 10
(4) Nick Markakis 2003 BC Autograph RC
(5) Drew Brees 2001 Topps Finest PSA 10 RC

Outside of court, I would settle for the book value of the cards. In court, I would sue for the cost of an additional Elements case and box. That is well over $300. I have Paypal transaction records to show all payments made to Mr. Nealey. He has nothing to show that he ever shipped anything....because he never did.

If Mr. Nealey would prefer it, I could provide snapshots of my Paypal transactions, showing that the funds were indeed transferred into his account. I also have all my bank transaction records for the last 14 months to prove no refunds were ever received....although this is quite unnecessary for me to provide, because Mr. Nealey is fully capable of looking into his own records and seeing that no refunds were ever issued.

Youtube messages with Jon starting in December.....

Re: Fanbro Banning Someone forwarded me a message from blowout saying you were still owed some items. I believe you may one of the honest souls that I do owe (not the ones issuing fraudulent chargebacks). So I'm going to offer a one time deal assuming you haven't issued a chargeback with paypal. We'll work something out and get you what you believe you are owed or you can continue whining on a message board and issuing empty threats that are going to get you nothing. Let me know.

-Jon

This e-mail was received right after I informed the blowout community that I had filed charges against Mr. Nealey with the IC3.
This is my response:

Re: one time offer Jon,

There was nothing to straighten out with Paypal. All you had to do was refund me. If you are still curious, here is what I am missing:

1. 5 box toppers
2. 1 case elements
3. 1 fanpack
4. Jay Bruce rookie auto (only thing I didn't pay for)

You've known exactly what I was missing from day one though, so I have difficulty believing that you have any intention of making this right. I guess we will see what happens.

My Response:

Re: one time offer This is a list of what I am missing from you.

1- case of elements- $266.99
1- fanpack- $21.99
5- box toppers
- Cole Hamels auto ball
- PSA10 2011 Topps Finest Drew Brees RC
- 2003 Bowman Chrome Markakis Auto RC
- BGS 10 Dwayne Wade Fleer Tradition RC
- 2007 Matt Wieters Elite RC Auto # to 799

It's been awhile since we last had contact. Obviously, I do not know whether you are really trying to make good on your mistakes or if you were just trying to get me to take back my claim. Here is what I do know.
1. I paid a lot of money for products that I neither received nor got reimbursed for. I did NOT receive any money from Paypal for reimbursement, due to your promises of shipping out the products.
2. Paypal sent you e-mails informing you that I was requesting a reimbursement. These e-mails were unanswered or reimbursement was denied by you.
3. The elements boxes were NOT pre-packaged. Product release dates for cards that showed up in the Elements boxes make this point clear.

As you know, I did file a complaint with the IC3. Minus the box break videos, which were taken down from youtube, I did document every suspicious interaction to include saving e-mails, chat conversations, and bank transaction statements. I cannot guarantee that my claim is thoroughly investigated, but it is filed nonetheless. If you are serious about making good on what you owe me, then I have no problem documenting that as well and adding the resolution to my claim. If the issue is resolved, then no agency would waste the resources to go after you, and the issue would be settled. Basically, we could both move on. I am still fairly bitter about the whole incident, but I can appreciate atonement, and thus I can forgive. It is not and never was my intent to get payback. I simply wanted what I paid for or I wanted my money back. I also never wanted to see anyone else fall into a bad situation like this, which is why I filed the claim. The ball is in your court. Either you reimburse me or you don't. If you do not respond to this e-mail, then I will assume that you do not intend to reimburse me. In which case, I may still try civil court for monetary reimbursement, but that would be a hassle to both of us, being as we reside in different states. I would rather settle this on the personal level.

I never heard anything from Mr. Nealey after that last communication. I apologize for the copy/paste format of the e-mails. I have all the e-mails saved, so I can provide screen shots of them if Mr. Nealey tries to deny anything.

I appreciate your help. I have been trying for over a year, so I am not going to get my hopes up. I can also keep in touch with some of my co-victims. If Mr. Nealey wants back into the community, then I would hope that he tries to fully remedy the situation. Some of the co-victims had very minimal losses though (under $20)

Wait. Andrew gives his friends big hits? DOES THAT MEAN I'M NOT ANDREW'S FRIEND?!?!?! *runs around in a circle, crying, while flopping his hands around... you know - kind of like the woman running with the knife in The Shining... just without the knife.... or the crazy Jack Nicholson*

Edit: *or being a woman. :-/*

Crap, I must not be Andrew's friend either. I should probably stop throwing my money away.

You should try rounding up records of where you sent payment to Coastal so that Chris can try to possibly get you reimbursed. I wouldn't bother with specific items so that value is estimated. Find how much you put in, and that'll probably be he best way to get an amount back to you. Don't post anything of financial record publicly - just PM it to cgilmo.

Coastal knows what he owes me , and I posted on here an email from Coastal saying he owes me . I would be happy getting $300 . I think thats fair to ask , less then half the BV of everything owed . I just want this behide me .

This also leads me to believe Gilmore is a highly trained Korean masseuse, meaning, of course, this entire ordeal will end in a "happy ending."
