First off, he WONT win or get refunded until he proves to paypal he has returned it to the seller via delivery confirmation. Ask the seller if he will reimburse you for return shipping. No matter what his answer, the only thing to do is to secure it, put it in a PWE and send with delivery confirmation. THEN file a complaint with paypal. Anything else is bad advise.

If this is the case then the best advice is to file a never received claim and move on.

Incorrect. That is exactly what NOT to do. The seller has messages stating the OP has received the card. The seller will win...and only 1 dispute from the buyer allowed per item.

Why not just ask the seller if you can keep the card and get a $2-3 refund. I don't understand why this is so complicated.

He thought he was getting an autograph, but 2-3 bucks should take the sting out...

I said the same thing already, and would obviously do the same. It's so ridiculous and annoying.

Pens cost money, which is clearly an issue here.

Bitching and moaning won't get your money back. Be respectful, work it out with the seller. Stop posting about what an ass the seller is and just work it out on your own.

I'd mail him a silver sharpie if he'd forge miggy's signature, scan it, and keep us updated on what happens after the fact....

Re: diamond9sports, very hard to deal with

Wow...are we that desperate for drama on the board? It's a $6 card. At most you're overpaying by a dollar or two. If you need the money that badly, you really shouldn't be in this hobby.

For those telling him to keep the card and get a refund via paypal...I don't really see how that behavior could be close to being justified. I see absolutely no reason why the seller would request the card be sent back prior to issuing a refund. If he issues a refund first, there would be absolutely nothing preventing this kid from keeping the card and the money.

If this were a major purchase, I could see how this is issue comes up. It's a $6 card. Either forget about and move on, or send the card back and stop whining.

Stop pretending your time is valuable. You probably wasted an hour or more posting in this very topic alone.

Again, WORK IT OUT WITH THE SELLER. Stop posting on here. We can do nothing about your $5.

No need to file a paypal claim. You're protected here. You can always file a claim later if he doesn't refund you. I'm sure he will since he is a PowerSeller with 99.9% feedback. He wasn't trying to rip you off, he just made a simple mistake.

As for the guy who suggested stealing the card, you are a moron.

Feng- I've always thought you've taken the high road and been a solid voice of reason*... if the medical profession ever gets slow I am sure a sportscard discussion group somewhere would like you as a moderator.

*except for the Bonds fixation ;)
