Here is the story: bought a card when the product was introduced off of ebay.

card was selling for 80 I bought it for 65. Seller said they will send it next day.

Totally forgot about the card and realized I haven't received it, 2 weeks passed.

I emailed the seller asking if he has a tracking number.

He proceeded to give me the usual excuse that he had to row a boat across the atlantic to visit a sick relative.

I said no prob, I will take my money back.

He says he doesn't see the request for the refund and already sent it.

Opened up a dispute with paypal.

Here is where it gets interesting.....He says he sent the card but will gladly give me a refund if the card is returned.

Paypal gives me my money back immediately after he writes this in the paypal claim corrospondence field.

Technically if he is telling the truth the card is in the mail and I should have it in the next day or so.

Also, technically he can't dispute anything since the money has already been returned to me.

I plan on sending the card back once received since I can get the card for under 45 now, just curious if this has ever happened to anyone or if they have heard of this.

again:

Paypal decided in my favor BEFORE the card was returned back to the seller.

With no D/C, Paypal will not believe the seller.

Technically, you could unethically "win out" and get your money back and keep the card. And you can do this in any auction where the seller doesn't use D/C.

That's why ya gotta use DC on everything.

He said he used DC. I just find it strange the day after he said I jmailed it out, they immediately gave me my money back versus waiting for me to send the card back to the seller and waiting for him to post the card is fine and to return the money back to the buyer.

The only thing I have had happen was not getting the card(s) and then getting a refund, then cards show up
one was over a year and the other was a 6 months later. I then gave the money back to the sellers.

Great job by you, I commend your honesty. That is the norm, card doesn't come they give you your money back......but in this case the seller says he just sent the card in the mail and paypal gives you the refund anyways is a bit odd.

The person didn't send with DC, therefore Paypal made an immediate refund decision. If the person sent with DC, they would have provided that to Paypal and this thread would not have been created. I don't think you'll be seeing the card any time soon.

The thing is he didn't say it was in the mail two weeks ago, he said it was in the mail on monday. I don't think he knew to put in the tracking number, they thought he was full of hot air and just gave me my money back.

I fell paypal should have
1) asked for a tracking number.
2) allowed for a few days for me to receive it then a few more days for me to send it back since I said those were my intentions.

Maybe I am wrong, just seems like a hasty decision by Paypal.
