In the end, first concussion or 5th... ANY concussion could do someone in. I think a funnier transcript would be:
Lawyer: So, Mr. Cueto -- you kicking Mr. LaRue in the head with your metal cleats caused a debilitating concussion.
Cueto: So? He had concussions before.
I think the Hx of concussions is relevant when considering how much income is truly lost. I don't think, given the fact he has had 20 concussions before, you can pencil him in for a 20 year career. If he's been averaging 1 concussion/yr, then you can argue that the straw that breaks the camel's back was forthcoming anyway, kick to the head or not. This is all assuming you can prove that Cueto was maliciously trying to hurt other players.
