So if someone has 3 automobile accidents (none of which is their fault) that cause them over the course of time to have a severe limp then they shouldn't be able to sue if they are driving one day and get hit by a guy driving recklessly resulting in them losing that leg due to the accident?

I mean, they have a leg injury already. They chose to keep driving.

In the end, first concussion or 5th... ANY concussion could do someone in. I think a funnier transcript would be:

Lawyer: So, Mr. Cueto -- you kicking Mr. LaRue in the head with your metal cleats caused a debilitating concussion.
Cueto: So? He had concussions before.

I think the Hx of concussions is relevant when considering how much income is truly lost. I don't think, given the fact he has had 20 concussions before, you can pencil him in for a 20 year career. If he's been averaging 1 concussion/yr, then you can argue that the straw that breaks the camel's back was forthcoming anyway, kick to the head or not. This is all assuming you can prove that Cueto was maliciously trying to hurt other players.

And regardless. Fights in baseball happen.

They just do.

It was a thug move to do what Cueto did seeing how is he put himself in the position he was in. Now, a HUMAN BEING has lost a huge portion of his income and enjoyment of life because some young punk couldn't stick to pushing and shoving.

I feel so bad for LaRue. He will not be able to feed his family because his lifetime earnings is only 20 million.
bigredmachine is a homer and a moron. Cueto could be on the same level as Nyjer Morgan. and if you think Morgan did anything justified, then you have a serious, serious problem.

I don't think this would go to trial. Cueto brought a gun to a knife fight, I'm agreeing with you A Pharis. If it were to go to trial Cueto would lose, definitely. His action far surpassed anything else that was going on in that brawl, and he acted childish.

I can’t remember seeing any cases where the argument was that the defendant wasn’t fighting fair…though I’m sure it has been attempted.

I think a more accurate comparison to the Larue situation would be a driver entering a demolition derby and then complaining that one of the drivers ran into him and hurt his leg again.

I don't think that's the way it works.

If you punch somebody in the head, you get charged with assault.

If you use a weapon, such as a knife (or a pair of cleats) that's called assault with a deadly weapon, or aggravated assault.

Why wasn't Cueto charged with aggravated assault? That's what I don't get...

And as far as classy organizations go, well.... "Pete Rose" should pretty much put an end to that conversation.

Just making a point that a 5 min google search will come up with the same stuff for all teams
Also Daryl Kile didn't die of a drug overdose.
Kile's cause of death was listed as "coronary atherosclerosis, narrowing of the arteries supplying the heart muscle."

The Reds A: Enabled a drug user and B: Traded him due to him falling off the wagon while with the team.

Everyone in the Reds org knew Hamilton had relapsed and he did again with Texas.

Didn't Volquez get 50 games recently?

No matter what, what Cueto did was unecessary and stupid. If he were hit in the head next year by the Cardinals it would even it up.

~Actually according to Latrell Spreewell, he couldn't feed his family with the 3 year $21 million contract the T-Wolves offered him, so yes LaRue won't be able to feed his family either.~

Sucks but you can't complain about getting injured in a fight. It is an unfortunate situation but he willingly entered into a dangerous situation and got hurt b/c of it. He has no right to complain or blame others, he got injured because of his own actions. It's pathetic that every one is jumping on the "it's cueto's fault" band wagon. How can you be mad at a player who defends himself when being pushed.

I feel bad that his family may not live as comfortable as they are used to but they should blame Jason for willingly putting himself in a dangerous situation. The fact he new he was a concussion away from possible catastrophy makes his actions flat out stupid.

Bottom line if you start or jump into a fight you deserve what happens to you, I have no sympathy for him.

You know you are about a fracking idiot. Daryl Kile died of a heart attack in his sleep. You are a piece of work. Does your Mom know what you type in the basement?? If you are going to throw out crap..at least know what you are talking about. Yes Mark McGwire is the only player in baseball to have done steroids.. He did it alone and no one else did it. The Cardinals are the only team to ever have anyone take steroids. What an idiot comment....

If anyone needs to be held responsible it should be Carpenter who single-handedly rekindled the fight. It has been said that Carpenter dropped the N-bomb on Dusty Baker when everything was starting to settle down. Stay classy Chris.

Care to back up that claim with a link to where that has been "said"? Curious as I haven't seen that anywhere in any of the links I've ever seen discussing the brawl...

this is complete crap. Nobody has "said" this and it hasn't even been hinted at anywhere. "Dusty Baker said he hates Mexicans!" See, I can do it too.

Its was a known fact he was a serious Cocaine and Marijuana user. Using those drugs over a period of time will cause a heart attack. Several players including Matt Morris admitted they knew he had problems. No need to sugarcoat anything. Truth hurts sometimes.
