Amazing how silly some of these eBay issues are. The whole situation would not have happened should one of the following taken place.

1. Buyer pays within stated time.
2. Seller is not anal retentive when payment arrives 10 hours late.

Either of these are easily accomplished. It appears some 13 year old kid needed some money quickly to take his 200 pound sixth grade girlfriend on a date at the arcade. The buyer didn't notice this and paid too late for the boy to impress his girlfriend enough to get the dress off.

I've always thought eBay allowed 7-days to pay despite seller terms. After some digging I discovered this nugget when performing a site search:

Buyers who do not meet the seller’s terms as outlined in the item listing are not permitted to bid on or buy the item.

The reality is a seller cannot open a dispute for seven days. I am under the impression the buyer can and MUST still pay for the item when the dispute is opened otherwise a strike can be given. I am under the assumption if the buyer does not abide by auction terms then the item can be relisted or second offered without violating eBay's non-performing seller policy. I have never heard of anyone getting a strike after paying for an item. Perhaps those who state this happened can clarify as it makes zero sense based on how eBay outlines procedures.

Obviously if a seller needs money fast then reasonable or even low BIN w/immediate payment required is the way to go. I do not even put payment deadlines in my auctions as 80% of my buyers pay within 48 hours most of the rest pay within a week. Perhaps 1-2% of my payments received take longer than a week to arrive. I simply resend the invoice after 7 days and this subtly says I'm expecting your payment now. I've filed three NPBs in the last year out of perhaps a thousand transactions. On a side note: sellers are capable of removing strikes even after a year removed from the hammer date. (I sent some cards out before buyer's check cleared. Check bounced and buyer got cards and I got a $15 bank fee... Buyer contacted me a year later and sent paypal payment for cards and bank fee in exchange for strike removal... a win-win).

I rarely bid on auctions with stated payment deadlines of three days or less. This comes across as potential anal retentive seller. Further, I bid frequently ahead of payday and then pay for everything on payday. Sellers posting three day deadlines in between paydays lose my bid and potentially a solid spike in hammer price.

Nutshell: Buyers need to read the terms but strict sellers lose bids and customers. This coming from an eBay buyer/seller since Sept 1996 who has 5831 feedback score (100% last 12 months) and 4.9+ on all DSRs.

To answer your question......if the seller does not pay for the item in the specified amount of time in the auction, and a dispute is filed, and then pays after that, the seller holds the right to decide to refund the money and can leave an unpaid item strike.

No it isn't. You didn't follow the sellers guidelines. Why didn't you just pay when you won the item?

Right, right. That makes it all better. I get it. Not your responsibility, it's the seller's fault for not following ebay guidelines.

you are probably right the auction was only up for 3 days

So am I to understand the buyer, didn't read the description, even though he sold a lot of Bowman Chrome Draft cards with a misleading pic (Porcello Orange if I remember correctly), and expected the buyer to read the description to see the pictured item wasn't included?

On that note, I believe that the seller would be able to have the negative removed, since the terms of the "contract" weren't lived up to by the buyer. The auction wouldn't be valid, so the feedback wouldn't be representative of the transaction.

That makes me wonder.
If a buyer is paying via PayPal, and puts in the "message" area the following:

"Your acceptance of my payment guarantees your shipping my item(s) in one business day
from the date of this payment, or I shall receive partial and/or full refund of my payment"

No. The buyer agrees to the auction terms before bidding.

I'll give you that. It's about as sloppy english/grammar as you get. I guess I've just trained myself to read the descriptions very carefully to avoid situations like this.
