Thanks to the past few replies for adding reasonable conversation.
If the short selling for profit was mama_bear's aim, why would he deliver on the SP Game Used Hockey which took off like the Bowman Sterling baseball? He definitely lost a bunch of money there.. He also managed to deliver some of the Bowman Sterling before he was forced to quit. He didn't take off, because people do still contact him and he does still reply... For sure, he is refunding money and I don't think he is running from PayPal or any other creditor...
I have a hard time believing he was attempting to make a profit. I would think he lost money on just about every order placed with him, regardless if the product dropped in price?

These are just my observations.

I can't comment about the taking orders without already having orders for product. I didn't know about that....

He still had profit from the Chrome, which he used to buy the next stuff. If Sterling and some other stuff tanked, he makes money and keeps going, which means he can try the same thing with the next product. Then if the next one tanks, he fulfills orders in a few weeks and goes to the next one.

He would have kept going as long as enough tanked that he could make profit on something. Since the last couple things he was trying to get didn't nosedive, his previous profits dried up. It's all a balancing act with other people's money.

That's why it's illegal. You can't take money for something you don't have, or at least a legit order for (i.e. Pre-selling), with a hope that you can maybe get it in 4 weeks.

This is also why, at the end, he started shipping to those who paid the most first, regardless of when they bought. He couldn't afford chargebacks from the high dollar people and wanted to satisfy those transactions, leaving the cheap cases for later.

And as far as being blackballed by distributors. I really don't think it was the fact that they were being undercut, as the fact that once he was pretty much discovered, they didn't want their name associated with the guy. They saw something wasn't right and wanted no part of it.

This is certainly NOT illegal -- to take an order for something then go out and purchase it. MANY MANY businesses work with this model. I brought up the fact they were short selling on the first few pages; there's nothing illegal about short selling.

That being said, I do believe it's against eBay's rules -- but certainly not a criminal offense.

FWIW, from a legal standpoint, mama_bear isn't in the clear by providing refunds.

She owes people a case of Bowman Sterling. If she cannot provide same, she needs to provide the means to obtain same -- i.e. pay full market value for full restitution. If the cases are $2k and she sold at $1,100, she needs to come up with $2k per person.

If he truly is in St. Pete, and you bought a case (or more) from him... and I like you... I can make his life relatively unpleasant and put some more money in your pocket.

By illegal, I was meaning on ebay. Sorry about leaving it vague. I'm certainly not a lawyer, but have been on ebay for over 10 years, that's what I was going by. I know with the whole thing a couple years ago, they made people prove they bought things like xboxes to show they actually had the items to sell beforehand.

See below for the excuse mama bear sent me on ebay

Anything I write gets posted on the chat rooms so there is
no point in answering any further. I have had a slew of cases filed against
me claiming that that they received "cardboard" instead of the item. I
personally ship zero cases myself, so I have either been sabotaged by the
shipper or the receiver, but either way I have the authorities looking into
it but the damage is done. My funds have all been frozen by paypal and the
avalance of refunds due to the inability to pay for product continues to
snowball. I am getting hundreds of emails everyday and refuse to spend
every hour telling everyone what went down. Most already had a negative
opinion eventhough for more than 6 months I kept delivering. This was a
planned attack to destroy me and it worked. Believe what you want but read
between the lines on the blogs. I even got a heads up warning on sat night
that there was something coming down and I shrugged it off. I called ebay
and paypal when it was just begining on Sunday only to be told that they
would not get involved for 7 days and to try to work it out with the buyer.
That was a joke and whoever organized this was well aware of that
happening. How many other dealers have hate blogs 30 pages and 6 months
old. I guess I understand now how gang mentality works. Find the ***** and
hammer away until you kill the beast. Well, the beast is dead. You can all
get your funds back and now thank the lord that the threat to you is gone.
I wonder how much profit these same people made from buying from me for 6
months? None of those same people will lose a dime if they ask to be
refunds on the current items. This should make a nice cut and paste to the
blogs so you can all have another good laugh at my expense."
