Uh, this seems like a rather massive liability. Have you run this buy a legal department?

Do you know in which states you can sell this product?

Is there a cash equivalent for the *poker tournament*

This may have been brought up, but there's no way in hell I'd dabble in any kind of WSOP redemption.

I hope for your sake that you've thought the legal aspect of this through.

It just takes one single kind telling his parents he blew money on this because of the redemption, and you're screwed.

People selling this product will probably even need a lottery license in their state..

I certainly hope that you've run this by your legal department before making promises.

Holy Crap!
I didn't even think of something like that
What happens if a 14 year old kid like Dalton wins???
Any disclaimers?

Disclaimers aren't enough. Topps pushed the legal envelope by including "They're Money" cards and Razor is literally, walking a razor-thin line.

Putting a disclaimer and advising shop owners not to sell to minors isn't enough. This honestly just screams, "Biggest Logistical Headache Ever".

It's an awesome idea, but it really just takes one kid -- he doesn't even have to win a ticket, he just has to open a single pack -- and a set of angry parents for lawyers and it's huge trouble.

That would be hilarious. In order to enter the WSOP, you must be 21 (in case some were unaware of this). Just because I enjoy watching chaos unfold here on FCB, I hope some 15 year old kid gets one of these free entry tickets.

Edit: had to fix the age of WSOP entry. my bad.

Hey Brian, will the sunglasses/caps be auto'ed or coming with any kind of COA, because the Raymer glasses can be bought on ebay for 0.99$ so if they don't have nothing different it would be bad IMO.

They come with Razor COA as being TOURNAMENT WORN!.. We obtained directly form Greg!

It is 21 to enter the WSOP, in case you aren't aware.

We have run it by legal. There is no specific consideration for the entry. Seats (a minimum of 1, more if not all redemptions are redeemed) will be available through a No Purchase necessary offer. After that, it is a luck of the toss equivalent to a free throw shooting contest at a lakers game where the winner gets $10k!.... Or, when a trading card comapnay gives away a world series trip or dinner with Lebron.

Redemptions have no cash value (nor do we imply any cash value for these cards). They merely represent a seat at a private, free invitational tournament. The winner of the free tournament gets an entry as a gift from us.

You WILL NOT need a lottery license any more than you need one for selling a box of exquisite bkb where you have a chance of pulling a $25,000 card or a 2.00 card. Theorretically, one kid complaining they spent $500 on a box and ended up with $100 worth of cards could trigger the same legal question. This has been tested before and we are completely confident in its soundness.

There will be prominent legal disclaimers and statements/explanations on all packaging and I would not be surprised if a NOT FOR SALE TO MINORS ends up on the package in a prominent way. Ill leave this to the lawyers.
BG

p.s.- we werent going to announce this, but ALL TOURNAMENT PLAYERS will receive a prize for their participation.

My bad. Not sure why I thought it was 18. I went ahead and fixed my original post.

People can sue for anything. On the front of the box, if it says prize not available to anyone under the age of 21 (however it is fully transferrable), we will be covered and I would not worry for even a moment. Topps included CASH in boxes with no legal entanglements (and NO disclaimer).

Trust me, we will have the legal side covered. That's why it took so long for sell sheet while we covered all our bases. BG

If he somehow got one, he would have the right to sell it on ebay like any other trading card.

I know some people like poker cards, but I simply couldn't care less. They are about on the level of Pokemon or Magic cards to me... as in, they may be popular, but yuck.

I couldn't agree more. It's a fad product that will be forgotten about faster than Razor baseball products. But what do I know, I'm as uneducated in business as everyone else that doesn't suckle the teet of Razor.

I've been a fan of the poker players since before the fad. I like all kinds of things that are a bit off. If they did a winter olympic set, hell i'd like that. No idea why but I would.

I think whomever brought up the discussion about the legality of the contest and the potential headache if a person under 21 won such redemption to the WSOP play-in should receive a big smooch (a maybe a poker box or two) from Razor because that was a very very very helpful post

Brian,
I think an awesome idea would be to inlay the players card protector chip in a card...Would be tough I am sure especially for the shark Humberto carries...but that would be some sweet stuff

That's great -- I'm not trying to bust your balls or anything, I just wanted to make sure you had everything covered. The CASH or "They're Money" cards that you and I both mentioned are a horrible reference point. Just because Topps didn't get sued doesn't mean that you won't get sued.

From a legal standpoint (wait, wasn't it you that said never to give away free advice? hah) you'll basically have to live and die by the precedent established by Topps and UD in the case of a few years ago. That being: The Consumer Pays for Cards, and Gets Cards. Nothing More, and Nothing Less. Thrown in an NPN to cover your bases in some of the weird-states, exclude quebec, and you're good to go.

When you start giving away prizes via redemptions that are exclusive in some manner, that's when you start getting in trouble. I think the Poker Sites even run their contests or "sweepstakes" from one of the Caribbean Islands. I think brick & mortar casino's give it away under their lottery license.

From what I remember, It's Arizona, Florida and Ontario that're the weird states when it comes to contest law/sweepstakes law. I think Texas is amongst the best, so you may have lucked-out there.

I'm sure you can swing it, and who knows -- maybe cases being shipped with a release form builds some hype.

SIDE BET: I'll bet you the cost of the forms (1200 in Ontario) that If I file a claim against topps for illegal lottery on "They're Money" cards, they'll be reprimanded.

When you get these glasses from Greg, please tell him the 1993 State Fair wants their glasses back!
Those things are ridiculous and he looks like a tool wearing them!
