I'm not sure what occurred in your incident Eric but this is fully incorrect (the buyer has 7 day's to pay for the item before a NPB claim can go through, that is how Ebay works & that is how it has been for a very long time). Even if the seller refund's payment they still cannot win in the case of an NPB strike, as all the buyer has to do is verify to Ebay that payment was made. Ebay goes by thier guideline's, not the seller's (early on in my participation on Ebay, about 8-9 year's ago, I was informed on several account's by the Ebay personnel that Ebay's guideline's override that of any seller's guideline's if they contradict eachother & though I was furious at the time I basically have grown to understand that by accepting thier user agreement & by using thier site, I must follow thier rule's, regulation's, & guideline's- basically if one doesn't like the rule's or how it is being run then don't use it, & if you do use it, don't bitch & moan when something occur's that was forseeable or expected)! :D


This is a false statement. Ebay has restructured the way they view sellers guidelines. The buyer is entering a "contract" with the seller when they bid on and win and auction. If the seller says they want payment within 24 hours and it is clearly stated that way in the auction and you win it and dont abide by those rules, ebay will back up the seller.

Yes the seller must wait the 7 days to file the claim and process the strike, but he has the right to refuse and refund the payment and continue with the strike if his terms are not met.

If you had sent me a message yesterday, I would have paid you on the spot. I bid on 10+ auctions a day, I don't have the time to remember if a seller wants payment within 24 hours. I typically pay within 2 days of the auction ending. I have never heard of a seller wanting payment within 24 hours. I am not threatening you with a negative, but any seller that does not ship out an item after a buyer paid within 36 hours does deserve a negative. I am going to call eBay later tonight and do whatever they suggest.

I really hope that you guys work this out....it is getting pretty petty going back and forth like this over a simple auction. With you paying within the 7 days, I do not think you can get a strike and if you got negative feedback, I am sure that ebay would remove it once they heard the reasoning behind it...might take 90 days for them to respond though...

It wasn't a card you can't find elsewhere.

I agree. And if you pay for all of your auctions under normal circumstances, having a strike on your account doesn't mean anything.

plus, correct me if I'm wrong, but don't you get to respond in words to a feedback. I read those; when someone gets a negative and they respond, you can get part of the story some times. Of course, if it's the same lame-ass reply to every negative, that tells a story too.

I'd save that, and then if anything occurs where he files a strike, send it to eBay. He's not allowed to do things like that. It violates ebay rules.

I would tell this guy to go f himself, in the harshest way possible. Although it's not the smartest thing to do here.

You might benefit from contacting ebay help now. It might save hassle down the road, or get them on your side off the bat since you contacted first and explained.

The person has difficulty dealing with change and they like to be in control of a given situation.....personally I would have #1) never mentioned a negative #2) never mentioned getting ebay involved #3) would have apologized profusely and made a friend rather than butt heads. I would have said some BS like "I am very sorry for the delay, I hope you accept my apology you have many more items I plan on bidding and I hope this does not ruin our professional relationship. Once I win auction X I will be sure to follow YOUR explicit guidelines"

Buttered him up, let him be in control, then his guard is down and all is forgiven.

The BEST thing to do NOW: Tell him that neither side is going to win at this point, can we mutually agree to not complete the transaction that way no one receives poor feedback or damage to their ebay record.

Very good advice. Many times it just takes giving the other person the perception of control over the situation to get what you want.

Wrong, they can't leave a negative, so only the seller would receive damaging feedback, so JD has nothing to be worried about. That is the last thing he should do.

If I wanted to card, I would have played along with his stupid demands, left FB and paid, then he MUST send the item.

No where in the eBay rules does it say that if you leave positive feedback, you give up all rights to receive your auction item; feedback is not the end of a transaction. It's not like he then can't send the item. If he doesn't, you can still file an "Item not received" claim.

Then, block his id and NEVER deal with him again.

Hell, if you wanted to be a real dick, you could go back in and update your feedback and let people know that he has suspect customer service at best.

Yup, I would have chanced it. Paypal would come to my rescue in that instance.
